CHAPTER clx.
An Act to confirm certain Provisional Orders of the Local
A,D.

Government Board relating to Chiswick East Ham
Great Crosby and York. [15th August 1904.]

HEREAS the Local Government Board have made the
Provisional Orders set forth in the schedule hereto under
the provisions of the Puhlic Health Act 1875 :

And whereas it is requisite that the said Orders should he
confirmed by Parliament and that the provisions herein contained
should he enacted with reference to the Chiswick Order 1904 :
Be it therefore enacted by the King's most Excellent Majesty
by and with the advice and consent of the Lords Spiritual and
Temporal and Commons in this present Parliament assembled and
by the authority of the same as follows;
L The Orders set out in the schedule hereto shall be and the Orders in
same are hereby confirmed and all the provisions thereof shall schg^d
have full validity and force.
2.
The following provisions shall as regards the Chiswick Special pro-

have effect for the benefit and protection of the Most Noble Spencer tion of His

(1) The expression " the Duke " shall include the Duke of Devonshire,
Devonshire for the time being and any owner or owners
in fee simple for the time being of any portion (such
portion not being of less area than one acre) of the
land in the parish of Chiswick now belonging to the
Duke which is delineated and coloured green upon a

1904. plan (in this section referred to as " the plan ") signed
hy Peroival Ourrey on behalf of the Duke and hy Ernest
Frederick Collins on behalf of the Council:
(2) Notwithstanding anything contained in the Order the
Council shall not acquire a greater quantity of the
lands numbered two and three in the Schedule to the
Order than that delineated and coloured pink on the
plan situate on the east of the watercourse known as
the Duke's Ditch but in lieu of the remainder of the
said lands the Duke shall sell to the Council the land
coloured pink on the plan situate on the west of the
Duke's Ditch :
(3) The Council shall when required by the Duke construct
and at all times maintain in good repair and condition
(1) a road sixty feet wide upon the land coloured
brown on the plan from the point marked " A " to
the point marked " B " on the plan ;
(2) a bridge sixty feet wide or a culvert sixty feet
in length at the point marked " D " on the plan over
the Duke's Ditch and by means of such bridge or
culvert the aaid road shall be carried across the
Duke's Ditch; and
(3) a road fifty feet wide commencing at the
point marked "A" and terminating at the point
marked " C " on the plan such road to be carried
by a culvert across the Duke's Ditch ]
All works affecting the Duke's Ditch shall be
constructed in accordance with plans and specifica-
tions to be approved by the surveyor of the Duke
before the construction of the same is commenced
The Duke shall on the commencement of the Order
set apart the site of the said roads "A" to "B"
and " A " to " C " for the purpose of public high-
ways and shall on the completion of the purchase of
the said lands coloured pink on the plan pay to the
Council the sum of one thousand five hundred and
fifty pounds towards the expense of the construction
of the said road and culvert " A " to u C " :
(4) Nothing in this section contained or anything done
thereunder shall relieve the owners or occupiers (other
than the Duke) of the premises fronting adjoining or
