CHAPTER x.
An Act to confirm certain Provisional Orders of the Local
A.D.
1875.
Government Board relating to the Districts of Astley Ab-
botts,
the Borough of Barnstaple, the District of Bicester
Market End, the Special Drainage District of Childs Hill,
the Districts of Chiswick and Lepton, the Boroughs of Saint
Alban and Sheffield, and the District of Slaithwaite.

HEREAS the Local Government Board have, as regards the
several districts herein mentioned, made the Provisional
Orders set forth in the schedule hereunto annexed, under the
provisions of the Local Government Act, 1858, and the Public
Health Act, 1872, respectively :
And whereas it is requisite that the said Orders should be
confirmed by Parliament, and the provisions herein contained
should be enacted in reference to two of the said districts :
Be it therefore enacted by the Queen's most Excellent Majesty,
by and with the advice and consent of the Lords Spiritual and
Temporal, and Commons, in this present Parliament assembled, and
by the authority of the same, as f ollows:
1.

Prom and after the day when the Order relating to the district New name
of Bicester Market End takes effect, the name of the said district

shall be changed, and thenceforth it shall be termed the Bicester Bicester
district, and all matters and things previously bearing the name of Market End-
the Bicester Market End district or the Bicester King's End district
shall thenceforth bear the name of the Bicester district.

For the

Company (in this section called the Company) the several provisions
tectum of 0f the section shall have full effect:

and South- [a.) All works proposed by the Chiswick Improvement Commis-
E»iiw"y sioners (in this section called the Commissioners) to be
Company. executed in, upon, or in connexion with the lands
mentioned or referred to in the Provisional Order dated
the eleventh day of February one thousand eight hundred
and seventy-five, and by this Act made absolute, or in or
upon, over, under, or across any railway or work of the
Company, shall be made and maintained of such dimensions,
in such lines, on such levels, and in such manner as not
in any degree to obstruct or prejudice any part of the
Company's railway, works, or conveniences.
(5.) In order thereto the Commissioners from time to time shall
submit to the Company's principal engineer a proper and
sufficient description, plan, section, and specification of
such parts of each of those works respectively as are to be
made within twenty feet of the Company's railways, works,
or lands, for his consideration and reasonable approval
thereof,
and if in any case he do not within fourteen days
after the delivery thereof to him approve the same, with
such modifications, if any, thereof as he reasonably
requires, and sign the same in testimony of his approval
thereof,
and deliver the same so signed to the Commis-
sioners, or if the Commissioners object to any modification
thereof required by him, then they may submit the same
to a competent and impartial civil engineer appointed on
the application of the Commissioners and the Company, or
either of them, by' the President for the time being of the
Institution of Civil Engineers, for his consideration and
reasonable approval, to be in like manner testified by his
signature, and the Commissioners shall not begin the
execution of any of the works so shown on the respective
plan unless and until the same, with the section and
specification
thereof,
are so approved.
(c.) Those works respectively so far as they directly or indirectly
affect any part of the Company's railways, works, and
conveniences shall by and at the expense in all things of
the Commissioners be made and maintained in accordance
with the plans, sections, and specifications so approved,

and under the superintendence and to the satisfaction of

the Company's principal engineer, who from time to time
may at the expense of the Commissioners appoint and
employ such inspector and watchman to superintend the
execution of the works, and to secure the safety and non-
interruption of the Company's railway, and the traffic
thereon, as he thinks proper.
(d.) The Company, if and when they think fit, may execute for
and at the expense of the Commissioners all or any of
those works respectively which are to be made and
maintained in, upon, or within twenty feet from any part
of their railway, works, conveniences, and lands.
(e.) The Commissioners shall not without the consent of the
Company testified by writing signed by their secretary
acquire any part of their land or property, but if and where
any part of the Commissioners works is to be executed in
or upon any land of the Company, the Commissioners may
acquire an easement or right of making and maintaining
the work in that land in such manner as not to prejudice
any part of the Company's railways, works, and
conveniences.

This Act may be cited as the " Local Government Board's Short title.
Provisional Orders Confirmation Act, 1875 (No. 1)."
