Unlawful gaming -Unlawfully permitting use of premises for gaming - Gaming Houses Act, 1854 (17 18 Vict., c. 38) s. 4

Upon a prosecution for knowingly permitting premises to be used for purposes of unlawful gaming, evidence was given that the game in question, "fascination,"might be won without the winner having any opportunity to display any skill, and that a player might by his skill give the game to an opponent. Held, upon a case stated, that the defendant should be convicted as the element of chance and not of skill was predominant. Evidence of skill and chance considered. Grounds upon which Court should review decision of lower Court considered
