The Magistrates' Courts (Forms) (Amendment) Rules 1980

The Lord Chancellor in exercise of the powers conferred on him by section 15 of the Justices of the Peace Act 1949(a), as extended by section 122 of the Magistrates' Courts Act 1952(b) and section 5(1) of the Bail Act 1976(c), after consultation with the Rule Committee under the said section 15, hereby makes the following Rules:—

1. These Rules may be cited as the Magistrates' Courts (Forms) (Amendment) Rules 1980 and shall come into operation on 12th May 1980.

2. In the Schedule to the Magistrates' Courts (Forms) Rules 1968(d), in each of the forms numbered 146A, 146B, 146C and 146D the words "Last bail/custody decision (if any): (date)" and the words "Stage reached in proceedings:" shall be omitted.

EXPLANATORY NOTE

(This Note is not part of the Rules.)

Rule 75A of the Magistrates' Courts Rules 1968 (S.I. 1968/1920) (inserted by S.I. 1978/147) requires records about bail decisions to be entered in the court register and to contain the particulars set out in the appropriate prescribed form. The relevant prescribed forms (forms 146A, 146B, 146C and 146D in the Schedule to the Magistrates' Courts (Forms) Rules 1968) contain particulars relating to the date of the last bail/custody decision and to the stage reached in the proceedings. These Rules amend those forms so as to omit those particulars, which will thus no longer be required to...
