CHAPTER ccxL
An Act to authorise the Corporation of Manchester to
A.D.
1904.
construct tramways and street widenings "within and
beyond the city to confer further powers upon the
Corporation and neighbouring authorities with respect
to the exercise of powers relating to tramways works
and electricity within and beyoud the city and for other
purposes. [15th August 1904.]

HEREAS the lord mayor aldermen and citizens of the city
of Manchester (in this Act called "the Corporation") are
the owners of tramways within the city of Manchester and lessees
of tramways beyond the city and they are empowered to work
the same :
And whereas by the Manchester Southern Tramways Act 1903
the Manchester Southern Tramways Company were authorised to
construct certain tramways in the neighbourhood of the city with
power for the local authorities therein mentioned or the Corpo-
ration to construct the same subject in the event of the local
authorities exercising the power to their granting a lease of the
tramways to the Corporation:
And whereas it is expedient to empower the Corporation to
construct and work the additional tramways within and beyond the
city by this Act authorised subject to the powers and provisions
of this Act in favour of local authorities:
And whereas it is expedient that the Corporation should be
empowered to make and maintain the street widenings and other
works and to acquire the lands within and beyond the city in this
Act respectively mentioned or referred to subject to the powers
and provisions of this Act in favour of local authorities:

1904. And whereas a Bill has been introduced into Parliament the
short title of which is the Manchester Corporation (General Powers)
Act 1904 whereby it is proposed amongst other things to alter and
extend the boundaries of the city of Manchester so as to include
within the city certain adjoining districts including the urban
district of Withington and it is expedient in the event of the said
Bill passing into law and providing for the annexation of the
urban district of Withington that the Corporation should be
empowered to execute the street works in that district as by this
Act provided :
And whereas the Corporation have constructed works for sup-
plying and are supplying electrical energy within the city and
neighbourhood and it is expedient that the Corporation should be
authorised to lay down the electricity mains mentioned or referred
to in this Act and that further powers should be conferred upon
the Corporation in relation to such supply and also in reference to
their electricity undertaking as by this Act provided :
And whereas it is expedient to make such other provision as
this Act contains:
And whereas the purposes aforesaid cannot be effected without
the authority of Parliament:
And whereas estimates have been prepared by the Corporation
for the purchase of land for and the execution of the various works
by this Act authorised and such estimates are as follows: £
For and in connexion with the construction of
tramways and street works within the city - 32531
For and in connexion with the construction of
tramways within the urban district of Sale - 6996
For and in connexion with the construction of
street works in the last-mentioned district - 3500
For and in connexion with the construction of
tramways within the township of Dunham-
Massey - - 1495
For and in connexion with the construction of
street works within the urban district of
Withington 85000
And whereas the several woi'ks included in such estimates
respectively are permanent works and it is expedient that the cost
thereof should be spread over a term of years :

And whereas an absolute majority of the whole number of the AB. 1901.
council at a meeting held on the eleventh day of November one
thousand nine hundred and three after ten clear days notice by
public advertisement of such meeting and of the purpose thereof in
the Daily Dispatch a local newspaper published and circulating
in the city such notice being in addition to the ordinary notices
required for summoning such meeting resolved that the expense
in relation to promoting the Bill for this Act should be charged
•on the city rate:
And whereas such resolution was published twice in the said
Daily Dispatch and has received the approval of the Local Govern-
ment Board :
And whereas the propriety of the promotion of the Bill for this
Act was confirmed by an absolute majority of the whole number
-of the council at a further special meeting held in pursuance of a
similar notice on the twenty-seventh day of January one thousand
nine hundred and four being not less than fourteen days after the
deposit of the Bill in Parliament:
And whereas in relation to the promotion of the Bill for this
Act the requirements contained in the First Schedule of the
Borough Funds Act 1903 have been observed :
And whereas plans and sections showing the lines and levels
of the works authorised by this Act and books of reference con-
taining the names of the owners and lessees or reputed owners and
lessees and of the occupiers of the lands required or which may be
taken for the purposes or under the powers of this Act were duly
deposited with the clerk of the peace for the county of Lancaster
and with the clerk of the peace for the county of Chester and are
in this Act respectively referred to as the deposited plans sections
and books of reference :
May it therefore please Your Majesty that it may be enacted
and be it enacted by the King's most Excellent Majesty by and
with the advice and consent of the Lords Spiritual and Temporal
and Commons in this present Parliament assembled and by the
authority of the same as follows (tbat is to say):

This Act may be cited for all purposes as the Manchester Short title.

The following Acts and parts of Acts so far as they are Incorpora-
applicable for the purposes and are not inconsistent with the tlon of ActF"
