[34] Mansell contra Middleton, in Mich. 14 Car. [1638]. Penniman contra Jennings, lands given to churchwardens, void in law, decreed hereabout, 2 Car. [1626-27]. Pember contra Inhabitant de Kington, whether money given to maintain a preaching minister be a charitable use, the Lord Keeper and the judges did decree (notwithstanding it is not warranted by the statute to be a charitable use) that the same shall be paid by the executor to such maintenance, in Trin. 15 Car. [1639]. Pensterd contra Pavier, A. deviseth twenty pounds per annum, to a preaching minister, dies, leaving lands and assets, the defendant will not pay it accordingly, the Court with the judges chargeth her out of the assets, to buy lands to perpetuate it, in Trin. 15 Car.
