mason versus abdy. Mich. 3 Jac. II. B. R. Rot. 575. What shall be an usurious contract. Comb. 125, S. C. 1 Show. 8, S. C. Debt upon bond, the condition whereof was, that whereas the above-named John Mason, at the request of the above-bounden John Abdy, had lent and paid unto him, the principal sum of 3001. on adventure upon the natural life of Robert Abdy, for the time herein after specified; if therefore the said Robert Abdy, at the end of three months kalendary, commencing from the date hereof, do and shall well and truly pay, or cause to be paid, unto the abovesaid John Mason, his executors or administrators, the sura of 221. 10s. being the premium for the said adventure of the said principal for three months; and afterwards, at the end of six months, commencing as aforesaid, or at any time sooner, do pay as aforesaid, the said principal sum of 3001. with other premium, for the farther adventure of the same, according to the rate of six-pence each pound per month, for all such time whatsoever as shall be expired and spent, at such assigned time of payment; or if before such assigned time or times of payment, and within the said six months, the said Robert Abdy shall depart this natural life, that then this present obligation shall be void. Quibus lectis & auditis, the said Robert Abdy dicit, &c. quod actio non, &c. because on the same day, year and place in the declaration mentioned corrupte & contra formam statuti in hujusmodi casu nuper edit. & provis. agreatum fuit inter prsediot. Johannem & eundem Robertum quod prsedict. Johannes accommodaret eidem Roberto summam 3001. & daret diem pro solutione inde per spacium trium raensiuiu calendar, sed non ultra sex mensium a prsedicto die quodq; pra)d. Robertus solveret, &c.
