The Secretary of State, in exercise of powers conferred on him by sections 11(1) and (4), 12(12), 15(1), 86(1) and 94(1) of the Weights and Measures Act 1985( a)and of all other powers enabling him in that behalf, hereby makes the following Regulations:--

1. These Regulations may be cited as the Measuring Equipment (Liquid Fuel delivered from Road Tankers) (Amendment) Regulations 1986 and shall come into operation on 11th August 1986.

2. The Measuring Equipment (Liquid Fuel delivered from Road Tankers) Regulations 1983( b) are hereby amended as follows.

3. In Regulation 2--

(a) in paragraph (1)--

(i) there shall be inserted at the appropriate places in alphabetical order the following definitions:--

""bottom loaded compartment" means a compartment which is designed for filling from the bottom and incorporates a dipstick measuring system or a contents gauging system whose calibration includes the volume of pipework between the foot valve and the outlet valve;";

""frustrated delivery" means a planned delivery which cannot be completed because:--

(a) there is not enough space in the customer's storage tank, or

(b) continuing the delivery would result in prohibited mixing of fuels or contamination, or

(c) a component of the measuring system breaks down;";

""tank shell" means the skin forming the inner surface of the compartment;"; and

""top loaded compartment" means a compartment which is designed for filling from the top;";

(ii) in the definition of "the Act" for the words "Weights and Measures Act 1963" there shall be substituted the words "Weights and Measures Act 1985"; and

(iii) in the definition of "compartment" the words "but does not include" onwards shall be deleted; and

(b) in paragraph (3), there shall be added the following units:--

"Second ……………………………… ..s

Square millimetre ……………… mm2".

4. In Regulation 3--

(a) in paragraph (1), for the words "paragraph (2) below" there shall be substituted the words "paragraphs (2) and (3) below";

(b) in paragraph (2)(a), for the words "dispensed at other than ambient temperature" there shall be substituted the words "with a kinematic viscosity exceeding 100 mm2/s at 15°C"; and

(c) after paragraph (2) there shall be added the following paragraphs:--

"(3) Except for Regulations 4, 5, 17 and 36 below, these Regulations do not apply to meter measuring systems which bear the mark of EEC initial verification.

(4) In this Regulation, "mark of EEC initial verification" means the mark described in paragraph 5 of Schedule 1 to the Measuring Instruments (EEC Requirements) Regulations 1980( a).".
