The Medicines (Committee on Safety of Medicines) Order 197019thAugust 1970

The Secretaries of State respectively concerned with health in England, in Wales and in Scotland and the Minister of Health and Social Services for Northern Ireland, acting jointly, in exercise of their powers under section 4 of the Medicines Act 1968(a), as having effect subject to the provisions of article 2(2) of and Schedule 1 to the Transfer of Functions (Wales) Order 1969(b), and of all other powers enabling them in that behalf, having regard to the recommendations made by the Medicines Commission and after consulting such organisations as they consider appropriate including those which appear to them to be representative of interests likely to be substantially affected by the following order, hereby order as follows:—
Citation and commencement
1. This order may be cited as the Medicines (Committee on Safety of Medicines) Order 1970 and shall come into operation on 7th September 1970.
Interpretation
2.—(1) In this order "The Act" means the Medicines Act 1968.
(2) Section 132(2) of the Act (which specifies the consideration which shall be taken to be included in considerations of safety in relation to any substance or article) shall apply for the purposes of this order as it applies for the purposes of the Act.
(3) The Interpretation Act 1889(c) shall apply to the interpretation of this order as it applies to the interpretation of an Act of Parliament.
Establishment of the Committee on Safety of Medicines
3. There shall be established a committee to be called the Committee on Safety of Medicines for the following purposes:—
(a) giving advice with respect to safety, quality and efficacy, in relation to human use, of any substance or article (not being an instrument, apparatus or appliance) to which any provision of the Act is applicable; and
(a) 1968 c. 67.

(c) 1889 c. 63.
(b) promoting the collection and investigation of information relating to adverse reactions, for the purpose of enabling such advice to be given.
