The Medicines (General Sale List) Amendment Order 1979

The Secretary of State concerned with health in England, the Secretaries of State respectively concerned with health and with agriculture in Wales and in Scotland, the Minister of Agriculture, Fisheries and Food, the Department of Health and Social Services for Northern Ireland and the Department of Agriculture for Northern Ireland, acting jointly, in exercise of powers conferred by sections 51 and 129(4) of the Medicines Act 1968(a) and now vested in them(b) and of all other powers enabling them in that behalf, after consulting such organisations as appear to them to be representative of interests likely to be substantially affected by the following order, and after taking into account the advice of the Medicines Commission, hereby make the following order:—

Citation, commencement and interpretation

1.—(1) This order, which may be cited as the Medicines (General Sale List) Amendment Order 1979, amends the Medicines (General Sale List) Order 1977(c) (hereinafter referred to as "the principal order") and shall come into operation on 12th April 1979.

(2) In this order, unless the context otherwise requires, a reference to adding an entry to a column in a Schedule to, or in a Table in a Schedule to, the principal order shall be construed as a reference to inserting that entry at the appropriate point in the alphabetical order of the entries in column 1 of that Schedule or, as the case may be, that Table.

Amendment of Schedule 1 to the principal order

2.—(1) Schedule 1 to the principal order (medicinal products for human use on general sale) is amended in accordance with the following paragraphs of this article and shall have effect accordingly as set out in Part I of Schedule 1 to this order.

(a) 1968 c. 67.

(b) In the case of the Secretaries of State concerned with health in England and in Wales by virtue of Article 2(2) of, and Schedule 1 to, the Transfer of Functions (Wales) Order 1969 (S.I. 1969/388), in the case of the Secretary of State concerned with agriculture in Wales by virtue of Article 2(3) of, and Schedule 1 to, the Transfer of Functions (Wales) (No. 1) Order 1978 (S.I. 1978/272) and in the case of the Northern Ireland Departments by virtue of section 40 of, and Schedule 5 to, the Northern Ireland Constitution Act 1973 (c. 36), and section 1(3) of, and paragraph 2(1)(6) of Schedule 1 to, the Northern Ireland Act 1974 (c. 28).

(c) S.I. 1977/2129.

(2) There are added to columns 1 and 2 the entries specified in columns 1 and 2 respectively in Part II of Schedule 1 to this order.

(3) There are deleted—

(a) from column 1 the entries "Altacite Suspension 0109/0041", "Altacite Tabs 0109/0040", "Beecham's Headache Tablet with Paracetamol 0079/0156", "Germolene Acne Gel 0079/0169" and "New Phensic 0079/0176" and the words "— New Formula" where they appear after "Sellers Tablets", and

(b) from column 2 the entry "25" where it appears in relation to "Beecham's Headache Tablet with Paracetamol 0079/0156" and "New Phensic 0079/0176".

(4) In column 1 for "Orovite Seven" there is substituted "Orovite "7," " and for "0209/0004", "0430/0009", "0430/0008" and "0430/0011" (product licence numbers relating to Ralgex Balm, "Savlon" Antiseptic Cream, "Savlon" Babycare Cream and "Savlon" Liquid Antiseptic) there are substituted "2156/0075", "3455/0002", "3455/0001" and "3455/0003" respectively.

Amendment of Schedule 2 to the principal order

3.—(1) Schedule 2 to the principal order (veterinary drugs on general sale) is amended in accordance with the following paragraphs of this article and shall have effect accordingly as set out in Part I of Schedule 2 to this order.

(2) There are added to columns 1 and 2 the entries specified in columns 1 and 2 respectively in Part II of Schedule 2 to this order.

(3) There are deleted from column 1 the entries "Hooflex 1847/4017", "Mainprize's Ray Preventive Powders 2443/4002", "Sectovap Dog Basket Pest Destroyer 2548/4000" and "Wardotrane Antiseptic Plastic Dressing 1873/4064".

(4) In column 1—

(a) for "Masodine RTU Teat Dip 1981/4003" there is substituted the following:

"Masodine RTU Teat Dip Orbisan Ready to Use 1981/4003"

and

(b) for "Sergeants Sentry IV Large Dog Collar" there is substituted "Sergeants Flea Collar for Large Dogs".

Amendment of Schedule 3 to the principal order

4.—(1) Schedule 3 to the principal order (licence of right products for human use on general sale) is amended in accordance with the following paragraphs of this article.

(2) In Table A (internal or external use)—

(a) there are added to columns 1, 2, 3, 4 and 5 the entries specified in columns 1, 2, 3, 4 and 5 respectively in Part I of Schedule 3 to this order, and

(b) for the entries in columns 2 and 3 relating to Methyl Salicylate there are substituted the entries in columns 2 and 3 respectively in Part II of Schedule 3 to this order, and entries relating to that substance shall have effect accordingly as set out in that Part.

(3) In Table B (external use only)—

(a) there are deleted from column 1 the entry "Salicylic Acid" and from columns 2 and 3 the entries relating to Salicylic Acid, and

(b) in column 1 for "Trichlorohydroxydiphenylether" there is substituted "Triclosan".

Amendment of Schedule 4 to the principal order

5.—(1) Schedule 4 to the principal order (licence of right veterinary drugs on general sale) is amended in accordance with the following paragraphs of this article.

(2) In Table A (internal or external use)—

(a) there are added to columns 1 and 4 the entries set out in columns 1 and 4 respectively in Schedule 4 to this order, and

(b) there is deleted from column 1 the entry "Glucose".

(3) In Table B (external use only)—

(a) there are added to column 1 the entries "Triclosan" and "Wool Fat", and

(b) there are deleted from column 1 the entries "Camphor", "Capsicum Oleoresin", "Isopropyl Alcohol" and "Propylene Glycol".

Amendment of Schedule 5 to the principal order

6.—(1) Schedule 5 to the principal order (automatic machines section of the general sale list) is amended in accordance with the following paragraphs of this article and shall have effect accordingly as set out in Schedule 5 to this order.

(2) To column 1 (name and product licence number of medicinal product) there are added the entries "Bayer Aspirin Tablets 0010/0020", "Cherish Toothpaste 0049/0018", "Colgate Dental Cream 0049/0016", "Colgate Fluor Dental Cream 0049/0017" and "Sensodyne Toothpaste 0036/5011".

(3) In column 2 (dosage units per container or package) opposite and relating to the new entry in column 1 "Bayer Aspirin Tablets 0010/0020" there is inserted "10".
