Approval of the 12th supplemental agreement to the track access
contract between Network Rail Infrastructure Limited and Merseyrail
Electrics 2002 Limited dated 1 April 2019
We have today approved the above supplemental agreement submitted to us formally on
18 July 2023 under section 22 of the Railways Act 1993 (the Act). This follows an earlier
informal submission of a draft agreement for our consideration. This letter explains the
reasons for our decision.
Purpose
The purpose of this agreement is to amend the effective date of the Lookup Table for EBM
Weights in Annex B to Part 3 of Schedule 4. The table was recently amended as part of
the 8th supplemental agreement, but the effective date was incorrectly stated as 21 May
2023 when it should have been 4 March 2023. The amendment will insert a footnote to the
relevant table in order to make it applicable from the correct date, and will be effective
upon ORR approval.
Industry consultation
As no third party is affected by this amendment, industry consultation was not necessary.
