An
Act to incorporate the
Mid-Yorkshire
Tramways
A.D.
1903.
-
Company and
to
empower that Company to make and
maintain tramways
and
other
works
and
for
other
purposes. [14th August
1903.1
‘HEREAS
the making and maintaining
of
the tramways and
\I&
other works hereinafter described and authorised
by
this Act
and the working
of
such tramways by mechanical power would be
of
public and local advantage
:
And
whereas the persons
in
that behalf in thip Act named with
others ere willing
at
their own expense to construct the tramways
if
authorised
by
Parliament
so
to
do and are desirous of being
incorporated into a company (hereinafter called
the Company
”)
with adequate powers
for
the piirpose and
it
is
expedient that
they be incorporated and empowered accordingly as by this Act
provided
:
And whereas by the Shipley Improvement Act
1901
the urban
district council of Shipley (hereinafter called
the Shipley
Council
”)
were empowered to construct certain tramways within
the urban district of Shipley and were authorised
to
enter into and
carry into effect agreements with the owner and lessee
of
any
tramways
in
any adjacent district which can be worked with any
of
the tramways of the Shipley Council and with the local authority
of such district with respect (inter alia)
to
the construction leasing
or
working
by
the contracting partiea
of
all
or
any
of
their respective
tramways and works
or
any part
or
parts thereof
and
for
other
purposes
:
And whereas
by
the Bingley Urban Districa; Council Act
1901
the urban district council
of
Bingley (hereinafter called
the
Bingley Council”) were authorised to make and maintain within
their district
a
new road in that
Act
described

And whereas
it
is expedient that
the
Compaiiy and the
Bingley Council should be authorised
to
enter into and carry
into effect agreements relative to contributions being made
by
the Company to the said council towards the conotruction
of
the
said Street
Work
No.
3
:
And
whereas
it
is expedient that the Compaiiy and certain
local authorities should be empowered to enter into and carry into
effect agreements as hereinafter provided and that the other
powers mentioned
in
this Act be conferred upon the Company
and that the provisions of the Tramways Act
1870
as to the
purchase
of
the undertaking
of
the Company should be modified
as hereinafter mentioned
:
And whereas plans and sections showing the lines and levels
of
the tramways and other works by this Act authorised and showing
the lands required
or
which may be taken for the purposes
or
under
the powers of this Act and also a book
of
reference containing the
names
of
the
owners
and lessees
or
reputed owners and lessees and
of
the occupiers of those lands were duly deposited with the clerk of
the peace for the west riding
of
the county
of
York
and are herein-
after respectively referred to as the deposited plans sections and
book

And whereas tho purposes
of
this Act cannot be effected
without the authority
of
Parliament
:

Your
Majesty that
it
may be enacted
and be
it
enacted by the King's most Excellent Majesty by and
with the advice and consent
of
the
Lords
Spiritual ,,nd Temporal
and Commons in this present Parliament assembled and by the
authority of the same as follows
:-
1.
This Act may be ciced as the Mid-Yorkshire Tramways
Act
1903.
2.
The following Acts and parts
of
Acts (that
is
to say)
:-

and

and Part

the

so
far as they are applicable to and are not varied by

with the provisions
of
this Act are incorporated with and
form
part
of
this Act and shall apply to the undertaking of the Company.

In this Act the several words and expressions to which
meanings are assigned by the Acts wholly
or
partially incorporated

in this Act and in the

the purposes of the said
Acts mean with reference to

such rural district

The tramways

the street works
and
the undertaking
mean respectively the tramways the street works and the
undertaking and any part thereof
by
this Act authorised
;
‘‘
Mechanical power
includes electrical and every other motive
power not being animal power
;

contingencies

shall with reference to the
Company be construed
to
include the contingency
of
the undertaking being sold to the local authority at a
sum less than the aggregate amount of the capital and
debts of the Company.
