JUDGMENT ON
PRELIMINARY HEARING
The judgment of the Tribunal is that:
1. The claim for constructive unfair dismissal was not brought within the primary
three month time limit in accordance with section 111(2)(a) of the Employment
Rights Act 1996.
2. It was not reasonably practicable for the claimant to bring that complaint
within the primary three month time limit, but the claimant did not bring her
Employment Tribunal claim within a reasonable further period thereafter. The
claimant’s claim for constructive unfair dismissal is out of time and is dismissed.
3. The claimant did not bring her claim for discrimination on the grounds of
pregnancy and/or maternity within the primary three month time limit in accordance
with section 123(1)(a) of the Equality Act 2010. It is just and equitable to extend time
to 12 March 2019 for the submission of this complaint.
4. The claimant's claim of pregnancy and/or maternity discrimination contrary to
section 18 of the Equality Act 2010 will be dealt with at the final hearing on 4, 5 and 6
February 2020.
