The Monopolies and Mergers Commission (Membership of Groups for Newspaper Merger References) Order 1982

The Secretary of State, being of the opinion that the modifications to which this Order relates are appropriate for improving the performance by the Monopolies and Mergers Commission of their functions, in exercise of the powers conferred on him by section 24 of the Competition Act 1980(a) and of all other powers enabling him in that behalf, hereby makes the following Order:—

1. This Order may be cited as the Monopolies and Mergers Commission (Membership of Groups for Newspaper Merger References) Order 1982 and shall come into operation on 3rd January 1983.

2. Part II of Schedule 3 to the Fair Trading Act 1973(b) is hereby amended:—

(a) in paragraph 10(1) by the addition at the end of the following:—

"or, where the functions to be performed through the group relate to a newspaper merger reference, not less than five members, being, in that event, the additional members (if any) appointed by the Secretary of State under paragraph 22 of this Schedule for the purposes of the reference and such regular members of the Commission as the chairman may select."; and

(b) in paragraph 22, by the substitution for the words "three, four, or five" of the words "one, two, or three".

EXPLANATORY NOTE

(This Note is not part of the Order.)

The Order amends paragraphs 10(1) and 22 of Part II of Schedule 3 to the Fair Trading Act 1973 which make provision for the performance of certain functions of the Monopolies and Mergers Commission through a group of its members.
