  • The Secretary of State may make regulations prescribing (by reference to shape, construction or any other quality) types of equipment of any description to which this section applies that are recommended as conducive to the safety in the event of accident of prescribed classes of children in prescribed classes of motor vehicles.appropriate information is provided in relation to it in such manner as may be prescribed, andinappropriate information is not provided in relation to it.is not of a type so prescribed, oris sold or offered for sale in contravention of regulations under this section,of children not of a class prescribed in relation to equipment of that type, orof children in motor vehicles not of a class prescribed in relation to equipment of that type,A person shall not be convicted of an offence under this section in respect of the sale or offer for sale of equipment if he proves that it was sold or, as the case may be, offered for sale for export from Great Britain.The provisions of Schedule 1 to this Act shall have effect in relation to contraventions of this section.Regulations under this section may make different provision in relation to different circumstances.a restraining device for a child or for a carry-cot, orequipment designed for use by a child in conjunction with any description of restraining device.References in this section to selling or offering for sale include respectively references to letting on hire and offering to let on hire.(1) In the heading and in paragraphs 1 to 4 of Schedule 1 to the (2) In paragraph 5 of that Schedule the following sub-paragraph shall be inserted before sub-paragraph (1) —
    • (1A) Subject to the provisions of this paragraph, in any proceedings (whether in England and Wales or Scotland) for an offence under section 15A of this Act it shall be a defence for the accused to prove—
    • (a) if the offence is under subsection (3) (a) of that section—
    • (i) that he purchased the equipment in question as being of a type which could be lawfully sold or offered for sale as conducive to the safety in the event of accident of prescribed classes of children in prescribed classes of motor vehicles and with a written warranty to that effect;
    • (ii) that he had no reason to believe at the time of the commission of the alleged offence that it was not of...
