The Secretary of State for Social Services, as respects England, and the Secretary of State for Wales, as respects Wales, in exercise of powers conferred on them by sections 8(1), (1A), 9(2) and 126(4) of, and paragraph 2(1) of Schedule 5 to, the National Health Service Act 1977(a) and of all other powers enabling them in that behalf, being satisfied that each authority called in this Order by a name which incorporates the word "Teaching" is to provide for a university substantial facilities for clinical teaching, and after consultation with each university concerned with the facilities in question, hereby make the following Order:—

Citation and commencement

1. This Order may be cited as the National Health Service (Constitution of District Health Authorities) Order 1981 and shall come into operation on 1st April 1982.

Interpretation

2. In this Order:—

"the Act" means the National Health Service Act 1977;

"Authority" means a District Health Authority;

"the Determination of Districts Order" means the National Health Service (Determination of Districts) Order 1981(b);

"local authority" means as appropriate the council of a county, a district, a London borough, the Inner London Education Authority or the Common Council of the City of London;

"Regional Authority" means a Regional Health Authority.

(a) 1977 c. 49; sections 8 and 9 were amended by the Health Services Act 1980 (c. 53), section 1(7) and Schedule 1, Part I, paragraphs 28 and 29, and section 8(1) was extended by section 1(2) of the Health Services Act 1980. The National Health Service Act 1977 was extended to the Isles of Scilly by the Isles of Scilly (National Health Service) Order 1981 (S.I. 1981/1473).

Constitution of Authorities

3.—(1) There is hereby constituted for each of the districts set out in Part I of Schedule 1 and Part I of Schedule 2 to the Determination of Districts Order in place of the Area Health Authorities set out in Parts I and II of Schedule 1 to this Order an Authority for the purpose of exercising any functions exercisable by such an authority by virtue of any provision of the Act and for the purpose of exercising, on behalf of the Secretary of State, such of his functions relating to the health service as are specified in directions given, in respect of an Authority constituted for a district in England, by a Regional Authority under section 14 of the Act, or, in respect of an Authority constituted for a district in Wales, by the Secretary of State under section 13 of the Act.

(2) Each of the existing Area Health Authorities set out in column (3) of Schedule 2 to this Order shall continue to be constituted and shall be the Authority for each of the districts set out in column (2) of Part II of Schedule 1 to the Determination of Districts Order which correspond with the area of each of those Area Health Authorities set out in column (4) of the said Part II of the said Schedule 1.

(3) Each of the existing Area Health Authorities set out in column (3) of Schedule 3 to this Order shall continue to be constituted and shall be the Authority for each of the districts set out in column (2) of Part II of Schedule 2 to the Determination of Districts Order which corresponds with the area of each of those Area Health Authorities set out in column (3) of the said Part II of the said Schedule 2.

Names of Authorities

4.—(1) The Authority for each of the districts set out in Parts I and II of Schedule 1 to the Determination of Districts Order shall be known by the name that is set out in column (2) of Schedule 2 to this Order opposite the name of that district set out in column (1) of the said Schedule 2 and the name of each Authority is set out in the Part of the said Schedule 2 of which the number corresponds with the number specified in the National Health Service (Determination of Regions) Order 1981(a) for the region of the relevant...
