The National Health Service (Constitution of Health Boards) (Scotland) Order 1974

In exercise of the powers conferred upon me by section 13(1) of the National Health Service (Scotland) Act 1972(a), I hereby make the following order:—

1. This order may be cited as the National Health Service (Constitution of Health Boards) (Scotland) Order 1974 and shall come into operation on 18th March 1974.

2. The Interpretation Act 1889(b) shall apply for the interpretation of this order as it applies for the interpretation of an Act of Parliament.

3. There is hereby constituted for each of the areas set out in the Schedule to the National Health Service (Determination of Areas of Health Boards) (Scotland) Order 1974(c) (hereinafter called "the Areas Order") a Health Board for the purpose of exercising functions with respect to the administration of such health services provided by the Secretary of State as he may by order determine, and of making arrangements for the provision of the services mentioned in Part IV of the National Health Service (Scotland) Act 1947(d).

4. The Health Board for each area set out in the Schedule to the Areas Order shall be known by the title in column 1 of the Schedule to this order which incorporates the name of that area.

5. Each Health Board shall consist of a chairman appointed by the Secretary of State and such number of other members as may be so appointed, being not more than the number shown in column 2 of the Schedule to this order opposite the title of that Health Board, and the said members shall be appointed in accordance with the provisions of Part I of Schedule 1 to the National Health Service (Scotland) Act 1972.
