The National Health Service (Fund-Holding Practices) (Scotland) Amendment Regulations 1993

The Secretary of State, in exercise of powers conferred on him by sections 84A(4), 87B(5), 105(7), and 108(1) of the National Health Service (Scotland) Act 1978(1) and of all other powers enabling him in that behalf, hereby makes the following Regulations:

S-1 Citation, commencement and interpretation

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the National Health Service (Fund-Holding Practices) (Scotland) Amendment Regulations 1993 and shall come into force on 1st July 1993.

(2) In these Regulations, “the principal Regulations” means the National Health Service (Fund-Holding Practices) (Scotland) Regulations 1993(2).

S-2 Amendment of regulation 5 of the principal Regulations

2. In paragraph (8) of regulation 5 (appeals to the Secretary of State against refusal of recognition) of the principal Regulations after the words “a member of the practice” the words “or some other person” shall be inserted.

S-3 Amendment of regulation 6 of the principal Regulations

3. In regulation 6 (conditions for continuing recognition) of the principal Regulations at the beginning there shall be inserted the words “Subject to the provisions of Part IV of these Regulations”.

4. For paragraph (1) of regulation 17 (payment for goods and services) of the principal Regulations the following paragraph shall be substituted:–

“1 Subject to paragraphs (3) to (9) the members of a fund-holding practice shall apply the allotted sum to secure the purchase of such of the goods and services, other than general medical services, referred to in paragraph (2) as are necessary for the proper treatment of individuals on the lists of patients of the members of the practice and are appropriate in all the circumstances having regard, in particular, to the needs of all those individuals.”.

5. In regulation 20 (savings from the allotted sum) of the principal Regulations–

(a) a new paragraph (1) shall be inserted as follows:–
