In exercise of the powers conferred on me by sections 13(8) and 62 of the National Health Service (Scotland) Act 1972(a) and of all other powers enabling me in that behalf, I hereby make the following order:—

PART I

GENERAL

Citation and commencement

1. This order may be cited as the National Health Service (Joint Ophthalmic Committees) (Scotland) Order 1974 and shall come into operation on 1st April 1974.

Interpretation

2.—(1) In this order unless the context otherwise requires:—

"the Act of 1947" means the National Health Service (Scotland) Act 1947(a);

"the Act of 1972" means the National Health Service (Scotland) Act 1972(b);

"enactment" includes a provision in a statutory instrument;

"Health Board" means a board constituted under section 13 of the Act of 1972;

"health board areas" are those defined in The National Health Service (Determination of Areas of Health Boards) (Scotland) Order 1974(c);

"medical practitioner" means a registered medical practitioner;

"ophthalmic medical practitioner" means a medical practitioner having the qualifications prescribed by regulation 3 of the National Health Service (General Ophthalmic Services) (Scotland) Regulations 1974(d);

"ophthalmic optician" and "dispensing optician" have the same meanings as in section 80(1) of the Act of 1947 as substituted by section 20 of the Health Services and Public Health Act 1968(e);

"optician" means an ophthalmic optician or a dispensing optician.

(2) Unless the context otherwise requires references in this order to any enactment shall be construed as a reference to that enactment as amended or re-enacted by any subsequent enactment.

(3) The Interpretation Act 1889(f) shall apply for the interpretation of this order as it applies for the interpretation of an Act of Parliament.

ESTABLISHMENT AND CONSTITUTION OF JOINT OPHTHALMIC COMMITTEES
