The National Health Service (Vehicles) (Scotland) Order 1974

In exercise of the powers conferred on me by sections 22(3) and 23(1A) of the National Health Service (Scotland) Act 1972(a) (as inserted by Schedule 4 to the National Health Service Reorganisation Act 1973(b)), and of all other powers enabling me in that behalf, I hereby make the following order:—

Citation and commencement

1. This order may be cited as the National Health Service (Vehicles) (Scotland) Order 1974 and shall come into operation on 1st October 1974.

Interpretation

2.—(1) Unless the context otherwise requires, references in this order to any enactment shall be construed as references to that enactment as amended or re-enacted by any subsequent enactment.

(2) The Interpretation Act 1889(c) shall apply for the interpretation of this order as it applies for the interpretation of an Act of Parliament.

Modification of the Vehicles (Excise) Act 1971

3. Section 4(1) of the Vehicles (Excise) Act 1971(d) shall have effect as if after paragraph (k) there were added the following paragraph:—

"(l) vehicles which are made available by the Secretary of State to any local authority, education authority or voluntary organisation in Scotland in pursuance of section 22 or section 23 of the National Health Service (Scotland) Act 1972 and which are used in accordance with the terms on which they are so made available".

Modification of Part VI of the Road Traffic Act 1972

4. Section 144(2) of the Road Traffic Act 1972(e) shall have effect as if after paragraph (e) there were added the following paragraph:—

"(f) to a vehicle which is made available by the Secretary of State to any local authority, education authority or voluntary organisation in Scotland in pursuance of section 22 or section 23 of the National Health Service (Scotland) Act 1972 at a time when it is being used in accordance with the terms on which it is so made available".
