HEREAS th«re are within the Manor Or ToWnfhip of Newby f
in the Parifli of
Morland^
in the County of
Wejtmorland,
fe-
veral Open Common^ and Walte Grounds, containing by Ef-
timation One thoufand Acres, ior thereabouts; and alfo Two Common
Stinted Paftures, called Newby High Pqflure and Newby Low Pa/lure*
containing together by Eftirrmtion Three hundred Acres, be the fame more
or lefs : And whereas the Right Honourable William Vifcbunt Lowther is
Lord of the Manor and Owner of the Soil of the faid Open Commons and
Wafte Grounds, and of the faid Common Stinted Paftures, and of the
Coal Mines, Veins* and Seams of Coal, and other Mines and Minerals
therein : And whereas the Right Wotfhipful the Dean and Chapter of the
Cathedral Church of Saint Mary

in the County ofCumberland^ are
Patrons of the Vicarage, Parifh, and Parilli Church of
Morland
aforefaid, of
which the faid Manor or Townftiip of Newby is Parcel, and as fuch en-
titled to all the Tythes of Cotn, Grain, Hay, and all ether Great Tythes
arifing, renewing, and growing due within the faid Manor or Lord^iip

Jackfon
is the prefent Vicar and Incumbent
thereof,
and entitled to the Glebe Lands, and all Small Tythes, Modufcs, and
•Ecclefiaftical Dues whatfoever, arifing and growing due within the faid
Manor or Townfhip of Newby ; and the faid William Vifcount Lowther
is>
by virtue of a Leafe or Demife from the faid Dean and Chapter, entitled
to all the Tythes of Corn, Grain, Hay^ and all othe* Great Tythes arifing,
renewing, and growing due within the faid Manor or Lordfhip, for the
