profiling has become an important investigative tool. Chapters

Discussion Paper

on
Protection of
Human
Genetic Information
issued by the
Australian Law Reform Commission during 2002 deals with the obtaining and
use of
DNA
evidence in civil and criminal proceedings. Subjects discussed in
relation to the use of
DNA
in criminal proceedings include the integrity of
DNA
evidence, the presentation of
DNA
evidence, the admissibility of unlawfully
obtained
DNA
evidence and use of genetic information in postconviction reviews.
The Commission recommends inserting into the Evidence Act
1995
(Cth) a
standard jury direction regarding the need for caution in evaluating
DNA
evidence
and the statistical calculations relating to that evidence. The discussion paper is

The California Law Revision Commission has been studying the application of
rules of evidence to electronic communications. In February 2002 the California
Law Revision Commission made recommendations about
Electronic Communications
and Evidentiary Privilege
and in March it issued a discussion paper on
Waiver
of
Privilege
by
Disclosure.

On
15
August 2002 the New South Wales Law Reform Commission published an
issue paper about
Questioning of Complainants
by
Unrepresented Accused in Sexual Assault
Trials.
