Law reform
Juries—Australia
There is concern in Australia that the law and practice concerning the directions
to be given to juries by judges in criminal trials are unnecessarily complex,
unhelpful and a cause of appeals. Victoria has published a report on the subject
which recommends procedural, administrative and legislative reforms. New
South Wales published a Consultation Paper on the same subject in December
2008 and Queensland an issue paper in March 2009 (noted (2009) 13 E & P 260).

The Law Reform Commission of Western Australia proposes broadening the pool
of potential jurors to increase participation in the jury system. All aspects of juror
selection, eligibility and related procedures are discussed.

Expert evidence—EU
The Law Society has published an EU-funded report on expert evidence in England
and Wales and a final report on expert evidence in the EU. Both focus on the
instruction of expert witnesses, disclosure, funding, admissibility of evidence and
mutual assistance. Besides the two reports, the Law Society has uploaded the
reports of several other EU countries and miscellaneous related documents, all of
which are available at <http://international.lawsociety.org.uk/node/6234>.
