This Draft Report (for consultation prior to a Final Report in September) examines
the costs of accessing justice in Australia, the impact of those costs and recommen-
dations for improving access, including consideration of the impact of processes
of legal institutions and alternative processes and reforms that may reduce
those costs. A chapter on court processes calls for national adoption of case
management processes used in Australia’s Federal Court (including the abolition
of formal pleadings); empirical analysis of different case management processes;
judicial training; the adoption of an individual docket system; limiting general
discovery to information of direct relevance; and practice guidelines and check-
lists on e-discovery and early exchange of critical documents. A section on expert
evidence outlines innovations in the management of expert evidence in civil
proceedings, summarises the adoption of those processes in Australian courts and
recommends that all courts require parties to seek directions on expert evidence;
be empowered to appoint single or court experts; issue practice directions on
single, joint, court and concurrent expert evidence; and make greater use of
court-appointed ‘panels of experts’ and experts’ conferences.
