Whereas the General Nursing Council for Scotland have, in exercise of their powers under section 6 of the Nurses (Scotland) Act, 1951(a), made the Nurses (Scotland) Rules, 1954, and have submitted the said Rules to the Secretary of State for his approval:

Now, therefore, in exercise of the powers conferred on me by section 33 of the Nurses (Scotland) Act, 1951, and of all other powers enabling me in that behalf, I hereby approve the said Rules in the form set out in the schedule hereto.

This instrument may be cited as the Nurses (Scotland) Rules, 1954, Approval Instrument, 1954, and shall come into operation on the 15th day of April, 1954.

SCHEDULE

THE NURSES (SCOTLAND) RULES, 1954, DATED 2ND FEBRUARY, 1954, MADE BY THE GENERAL NURSING COUNCIL FOR SCOTLAND UNDER THE NURSES (SCOTLAND) ACT, 1951 (14 & 15 GEO. 6. C. 55).

The General Nursing Council for Scotland, in exercise of the powers conferred on them by the Nurses (Scotland) Act, 1951, hereby make the following Rules:—

PART I

General

1. These Rules may be cited as the Nurses (Scotland) Rules, 1954.

2.—(1) In these Rules, unless the context otherwise requires, the following expressions have the meanings hereby respectively assigned to them:—

"the Act" means the Nurses (Scotland) Act, 1951.

"the Council" means the General Nursing Council for Scotland established under section 1 of the Act.

"Hospital Group" means a group of hospitals administered by a single Board of Management, constituted in terms of sub-section 9 of section 11 of the National Health Service (Scotland) Act, 1947.

"the Register" means the Register of nurses maintained by the Council under section 2 of the Act.

"the Registrar" means the person appointed for the time being to act as Registrar of the Council under section 14 of the Act, and includes any person duly authorised to act and acting on her behalf.

"Registered General Nurse" means a nurse who is for the time being registered in the General Part of the Register.

"Registered Mental Nurse" means a nurse who is for the time being registered in the Supplementary Part containing the names of nurses trained in the nursing and care of persons suffering from mental diseases.

"Registered Nurse for Mental Defectives" means a nurse who is for the time being registered in the Supplementary Part containing the names of nurses trained in the nursing and care of persons suffering from mental defect.

"Registered Sick Children's Nurse" means a nurse who is for the time being registered in the Supplementary Part containing the names of nurses trained in the nursing of sick children.

"Registered Fever Nurse" means a nurse who is for the time being registered in the Supplementary Part containing the names of nurses trained in the nursing of persons suffering from fever.

"Registered Nurse Tutor" means a nurse who is for the time being registered on the General Part of the Register and who holds a Certificate of Registration as a Nurse Tutor granted by the Council.

(2) The Interpretation Act, 1889(a), applies to the interpretation of these Rules as it applies to the interpretation of an Act of Parliament, except that in these Rules, unless the context otherwise requires, the feminine gender includes the masculine.

3. The Rules specified in the First Schedule hereto are hereby revoked:

Provided that, without prejudice to the general application of section 38 of the Interpretation Act, 1889, with regard to the effect of repeals, in so far as any agreement, order, requirement, designation, application, request or representation made, or any resolution passed, or any notice, direction, consent, sanction, approval, exemption or certificate given under any Rule revoked by these Rules, or any conditions imposed or any proceedings instituted, or any other thing done, under any such Rules, could have been made, passed, given, imposed, instituted or done under or by a corresponding provision of these Rules it shall not be invalidated by these Rules but shall have effect as if it had been made, passed, given, imposed, instituted or done under or by that provision.

PART II

Proceedings of the Council and Committees

4.—(1) At the First Ordinary Meeting of the Council after the beginning of each financial year, as the same may be fixed by the Secretary of State for Scotland, the Council shall appoint from their members a Chairman and Vice-Chairman, who shall hold office until a Chairman and Vice-Chairman have been appointed at the First Ordinary Meeting of the Council after the beginning of the following financial year.

(2) If the office of Chairman or of Vice-Chairman becomes vacant during the year, it shall be filled at the next meeting of the Council, or at such later meeting as may be convenient, and the member appointed shall hold office for the remainder of the term of office of the person in whose place she is appointed.

(3) In the event of neither the Chairman nor the Vice-Chairman being present at any meeting of the Council, the Council shall appoint a Chairman to preside at that meeting.

5.—(1) Ordinary Meetings of the Council shall be held at such times and places as the Council may appoint.

(2) An Extraordinary Meeting of the Council may be convened by the Chairman at any time, and shall be convened by the Registrar and be held within fourteen days after receiving a requisition so to do signed by any six members of the Council and stating the business which they desire to be considered. At an Extraordinary Meeting no business shall be dealt with except such as may be specified in the Notice of the Meeting.

(3) Not less than seven days' notice of any meeting shall be given to each member of the Council, directed to such address as she shall from time to time furnish to the Registrar. Such notice shall specify the Agenda, and shall be accompanied by a draft of the Minute of the previous meeting and by any necessary documents relative to the Agenda. Business not specified in the Notice of an Ordinary Meeting may be taken only by permission of the Chairman of the meeting.

(4) A Notice of Motion of business to be included in the Agenda may be given at a Council Meeting for inclusion in the Notice of Meeting for the next meeting of Council.

6. Seven members of the Council shall be a quorum, and no business shall be transacted until and unless a quorum is present.

7. If within fifteen minutes from the time appointed for a meeting a quorum is not present, the meeting shall stand adjourned to a date and a place to be fixed by the Chairman of the meeting and intimated to the Members of the Council. At such adjourned meeting five members shall be a quorum.

8. The Registrar shall act as Secretary of the Council and shall keep Minutes of the Proceedings.

9. Every question submitted to the meeting shall be decided by vote, when the Chairman shall have a deliberative vote, and in the case of an equality of votes the Chairman shall have a casting vote.

10. The Chairman of the meeting may, with the consent of the meeting, adjourn the same from time to time and from place to place, but no business shall be transacted at any adjourned meeting other than the business left unfinished at the meeting from which the adjournment took place.

11. At a meeting of the Council the Chairman of the meeting shall decide upon any point of order or procedure, and her decision shall be final.

12.—(1) At the first Ordinary Meeting after the beginning of each financial year the Council shall appoint a Finance Committee and a Discipline Committee, and may appoint such further Committees as they think fit and may delegate thereto any of their powers and duties, either by these presents or otherwise.

(2) The Chairman and Vice-Chairman of the Council shall be ex officio members of every Committee.

13.—(1) Each Committee shall elect its own Chairman.

(2) Each Committee shall cause Minutes of its proceedings to be kept and shall report to the Council at such time and in such manner as the Council shall appoint.

(3) No expenditure shall be incurred by a Committee without the consent of the Council.

(4) The quorum of a Committee shall be three, unless the Council shall fix a larger number in the case of a particular Committee.

(5) The Registrar shall act as Secretary to each Committee. Meetings of a Committee shall be convened by the Registrar on the instructions of the Chairman of that Committee or on the requisition of two members.

(6) Subject to the foregoing provisions of this Rule, these Rules, so far as relating to the procedure of the Council, shall apply with the necessary modifications to the procedure of Committees.

14.—(1) All accounts and claims shall be examined by the Registrar and laid by her before the Finance Committee, who shall report thereon to the Council, and such accounts and claims as are allowed shall be initialled by a member of the Finance Committee for payment.

(2) All cheques for payment of money shall be signed by a member of the Finance Committee and countersigned by the Registrar.

15. At every Ordinary Meeting of the Council the Registrar shall present a statement of the Council's Cash Balances and Investments at such date as the Council may determine.

16. All Minutes, Registers and Records shall be open to the inspection of Members of the Council during the Registrar's business hours.

PART III

Maintenance and Publication of the Register

17.—(1) The Register shall consist of the Parts specified in paragraphs (a), (b), (c), (d) and (e) of subsection (2) of section 2 of the Act.

(2) Each nurse on being admitted to the Register shall be assigned a registration number in each Part of the Register in which her name is included.
