An Act to repeal An Act for more effectually
amending the Road from Oldham in the County
of Lancaster to Ripponden in the County of
York, and other Roads in the same Counties, and
for making and maintaining a new Branch to
communicate therewith, and to make other Pro-
visions in lieu
thereof,
so far as regards the said
Road from Oldham to Ripponden, and the other
Roads already made in connexion therewith.

HEREAS an Act was passed in the Tenth Year of the
Reign of King
George
the Fourth, intituled An Act for

of Lancaster to Ripponden in the County of York, and other
Roads in the same
Counties,
and for making and maintaining a new
Branch to
communicate
therewith: And whereas the Term of the said
recited Act will expire on the First Day of November One thousand
eight hundred and sixty-one unless Parliament shall in the meantime
continue the same : And whereas considerable Sums of Money had been
under previous Acts relating to the said Roads advanced and secured
on the Credit of the Tolls authorized to be taken on the Roads com-

prised in the said Act, and the Principal Sum of Fourteen thousand
four hundred and forty-four Pounds Eight Shillings, as specified in the
First Schedule to this Act annexed, with some unpaid Interest thereon,
as specified in the Second
.
Schedule to this Act annexed, still remain
due and owing, and the same cannot be paid off, nor can the said Roads
be effectually improved and kept in repair, unless further Powers and
a further Term be granted: And whereas by the said recited Act the
Trustees acting in execution thereof were authorized and empowered to
make an Extension or new Branch of Road from the said present Road
from Oldham to Ripponden, commencing at or near Spaw Bridge on
or near Booth Dean in the Township of Rishworth in the Parish of
Halifax in the County of York, and passing through the said Town-
ship of Rishworth, and the Townships of Butterworth and Casikton m.
the Parish of
Rochdale
in the County of
Lancaster,
and terminating at
or near Summer
Castle
in or near the Market Town of
Rochdale
in the
said County of 'Lancaster, and from or near a Place called Plumb Home
in the said Township of Butterworth, on the Southerly Side of the Fence
to the River Beal, to Fir Grove in the same Township, to join the
Hollinwood and
Littleborough
Turnpike Road there, but such Extension
or new Branch Road has not been made or in any way proceeded with,
and it is expedient that the Power to make the same should be relin-
quished: And whereas it is also expedient that the said recited Act
should be repealed, and that further and more effectual Powers and
Provisions should be granted in lieu
thereof:
And whereas the said
Purposes cannot be effected without the Authority of Parliament: May
it therefore please Your Majesty that it may be enacted; and be it
enacted by the Queen's most Excellent Majesty, by and with the Advice
and Consent of the Lords Spiritual and Temporal, and Commons, in this
present Parliament assembled, and by the Authority of the same, as
follows ; (that is to say,)
Recited Act 1. From and after Twelve o'Clock at Night on the Thirty-first Day
repealed, 0f August One thousand eight hundred and sixty-one the said recited
to

shall be and the same is hereby repealed, and this Act shall thenceforth
be put in execution during the Term and for the Purposes herein-after
mentioned.
Short Title. 2. In citing this Act for any Purpose it shall be sufficient to use the
Expression, " The Oldham and Ripponden Roads Act,
1861."

In this Act the following Words and Expressions shall have the"
several Meanings hereby assigned to them, unless there
be"
something in
the Subject or Context repugnant to such Construction; (thatis to say,)
The Expression "the Trustees" or "the said Trustees" shall mean
the Trustees for the Time being acting in the Execution of this
Act: the
