An Act for amending an Act for rebuilding the
Church of Oldham in the County Palatine of
Lancaster, and for taking down and rebuilding
the Chancel and Private Chapels attached to the
same. [19th June 1828.]

HEREAS an Act was passed in the Fifth Year of the Reign of
His present Majesty, intituled An Act for taking down and SG.4-. c.64
rebuilding
the Body^the Church or
ancient
Parochial Chapel of
Ease.
ofOldham, within the Parish of Prestwich cum Oldham, in the
County
Palatine of Lancaster, for providing additional Burial Ground., and for
equalizing the Church Rates, and other
Purposes :"
And whereas there were
annexed to the Body of the said.Church or ancient Parochial Chapel.a
Chancel, claimed by the Rector of Prestwich, and also certain Private *^'
Chapels on each Side of the saSJfChancel, belonging to or claimed by cer- ^-W
fain Persons in right of particular Messuages within the said Chapelry :
And whereas-the Reverend James Lyon Clerk, Master of Arts, is
the present Rector of Prestwich cum Oldham aforesaid,' and^ the Right
Honourable
Thomas
Earl of Wilton claims to be Patron of the said Rectory
on the Decease of the present Rector : And whereas Charles Rhys Esquir&^^f
is or claims tq<r of. One of the said Chapelsknown by the Name

wood Spinster, are or claim to be Owners as Tenants in Common of the
other Part of the said Chapel: And whereas such Chancel and Private
Chapels have been left standing from Want of sufficient Powers in the
said recited Act to take down the same, and the same are in a ruinous and
dilapidated State and Condition, and the rebuilding of the Body of the
said Church now in progress cannot be completed without their entire Re-
moval : And whereas the Construction of Vaults under the Body of the said
Church for the Interment of the Dead would be very desirable and ad-
vantageous : And whereas it is necessary that the Powers contained in the
said first-mentioned Act should be altered and enlarged : And whereas the
several Purposes above mentioned cannot be effected without the Aid and
Authority of Parliament: May it therefore please Your Majesty that
it may be enacted; and be it enacted by the King's most Excellent
Majesty, by and with the Advice and Consent of the Lords Spiritual and
Temporal, and Commons, in this present Parliament assembled, and
by the Authority of the same; That the said recited Act, and all and every
the Powers* Provisions, Penalties, Forfeitures, Rates, Payments, Remedies,
Matters, and Things therein contained, (save and except such Parts thereof
as are varied, altered, or repealed by this Act,) shall respectively be as
good, valid, and effectual for carrying this Act and the several and
respective Purposes thereof into Execution, as if the same had respectively
been repeated and re-enacted in the Body of this Act.
II.
And whereas the Commissioners acting in the Execution of an Act
made and passed in the Third Year of the Reign of His present Majesty
King
George
the Fourth, intituled An Act to amend Two Acts of the Fifty-
seventh Tear of His late Majesty and the First Tear of His present Majesty, for
authorizing the
Issue
of Exchequer Bills, and the Advance of Money for carrying
on Public
Works
xand
Fisheries,
and
Employment
of the Poor, and
to
authorize
a further Issue of Exchequer Bills for the;
Purposes'
of the said Acts, and the
other Acts therein recited or referred to,, and the^Acts subsequently passed
for amending the same,'did, on or about the Nineteenth Day of July One
thousand eight hundred and twenty-seven, advance and lend to the Trustees
for carrying into Execution the said recited Act of the Fifth Year of the
Reign' of
His.
said present Majesty the Sum of Ten thousand Pounds in"
Exchequer Billsj upon the Security of an Indenture of Mortgage under the
Hands and Seals of Five of the Trustees appointed under and in pursuance of
the said last-mentioned Act, bearing Date the said' Nineteenth Daylbf Julf
One "thousand, eight hundredand twenty-seven; by which said Indenture
the said Trustees did for the Considerations therein-mentioned assign to.
William Hdlden Esquire, the Secretary of the 'said Commissioners for :the
Issue of Exchequer Bills, all and- every the Rates or 'Assessments-to be
raised, levied,' and collected by virtue of the said last-mentioned Act of
the Fifth Year of His said present Majesty, subject to Redemption as
therein ,particularly mentioned and expressed; be it therefore.enacted
and declared, That nothing in'this Act contained shall extend:or be
construed to extend to invalidate, defeat, 'make void, or in any Manner
incumber or affect thesaid Indenture of Mortgage bearing Date the said
Nineteenth Day of July One thousand eight hundred and twenty-seven;'
and that the same shall have Priority over, and shall precede' any Mortgage
