Introduction
[1] This is an application by the defendant, the Department of Agriculture,
Environment and Rural Affairs (“DAERA”) for an order pursuant to Regulation 96
of the Public Contracts Regulations 2015 (“PCRs”) to lift the automatic suspension,
imposed by Regulation 95, that the defendant refrain from entering into a contract
for the provision of a rural community support service for the Fermanagh and
Omagh District Council area (“the Contract”). The plaintiff objects to the
application.
[2] The defendant was represented by Mr Hopkins of counsel and the plaintiff
was represented by Mr Anderson of counsel. I am grateful to all counsel for their
comprehensive skeleton arguments and well-presented oral submissions.
