Dear Sirs
An open letter on NIAUR’s intention to include wording in proposed licence modifications to
ensure that such modifications do not constitute a “relevant change in law”
Under the Electricity (Single Wholesale Market) (Northern Ireland) Order 2007 (the SEM Order),
NIAUR has certain powers to modify licences held under the Electricity (Northern Ireland) Order
1992. Under the proposed Electricity Regulations (Northern Ireland) 2007 (the Regulations), which
are currently subject to consultation, NIAUR has certain further powers to modify such licences.
NIAUR has undertaken a number of consultations (some of which are ongoing) regarding the substance
of the modifications proposed.
Both the SEM Order and the Regulations contain statements to the effect that they do not constitute a
“relevant change in law” (Article 11 and Regulation 56 respectively).
It is NIAUR’s current intention to include similar statements in the notices by which it exercises its
powers to modify licences under the SEM Order and the Regulations so as to provide that the
modifications do not constitute “relevant changes in law”.
