The Secretary of State, in exercise of the powers conferred on him by section 2(1) of the Customs and Excise Duties (General Reliefs) Act 1979(a) (as regards relief from customs duties) and of all other powers enabling him in that behalf, and the Minister of Agriculture, Fisheries and Food and the Secretary of State, being Ministers designated(b) for the purposes of section 2(2) of the European Communities Act 1972(c) (as regards relief from agricultural levies) acting jointly, in exercise of the powers conferred on them by the said section 2(2) and of all other powers enabling them in that behalf, hereby make the following Regulations:—
1. These Regulations may be cited as the Outward Processing Relief (Amendment) Regulations 1982 and shall come into operation on 1st July 1982.
2. For Regulation 5(1) of the Outward Processing Relief Regulations 1979(d) there shall be substituted the following:
"Subject to the following provisions of this Regulation, the amount referred to in Regulation 4(1) is the amount of the customs duty and of the agricultural levy that would be chargeable on the importation of goods in the same state and in the same quantity as the goods were in when temporarily exported or a proportion of that amount determined according to the provisions of Commission Directive 81/952/EEC(e)."
