The Packaging and Labelling of Dangerous Substances (Amendment) Regulations 1981

The Secretary of State, being the designated (a) Minister for the purposes of section 2(2) of the European Communities Act 1972(b) in relation to the regulation and control of classification, packaging and labelling of dangerous substances and preparations, in exercise of the powers conferred upon him by the said section 2 and sections 15(1) and (3)(a) and 82(3)(a) of the Health and Safety at Work etc. Act 1974(c) ("the 1974 Act") and of all other powers enabling him in that behalf and for the purpose of giving effect without modifications to proposals submitted to him by the Health and Safety Commission under section 11(2)(d) of the 1974 Act after the carrying out by the said Commission of consultations in accordance with section 50(3) of that Act, hereby makes the following Regulations:—

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as The Packaging and Labelling of Dangerous Substances (Amendment) Regulations 1981 and shall come into operation on 1st July 1981 for all Regulations except Regulation 2(b) which shall come into operation on 1st January 1982.

(2) In these Regulations, unless the context otherwise requires—

(a) "the principal Regulations" mean the Packaging and Labelling of Dangerous Substances Regulations 1978(d), and

(b) any reference to a numbered Regulation or Schedule is a reference to the Regulation of, or Schedule to, the principal Regulations so numbered.

Amendments to Schedule 1

2. Schedule 1 (which specifies the substances which are prescribed dangerous substances) shall be amended as follows—

(a) S.I. 1976/897.

(b) 1972 c. 68.

(c) 1974 c. 37; section 15 was amended by the Employment Protection Act 1975 (c. 71), section 116 and Schedule 15, paragraph 6.

(d) S.I. 1978/209.

(a) where a substance is listed in column 1 of Schedule 1 to these Regulations in Part I, Part II, Part III, or Part IV, then for the corresponding entry for that substance in Schedule I to the principal Regulations, there shall be substituted the entry in Schedule I to these Regulations;

(b) there shall be inserted in that Schedule in the appropriate place in alphabetical order the entries in Schedule 2 to these Regulations.

Amendments to Schedule 3

3. In Schedule 3 (which lists indications of particular risks and combinations of such risks)—

(a) after the entry "40: possible risks of irreversible effects" there shall be inserted the following entries—

"42: May cause sensitisation by inhalation

43: May cause sensitisation by skin contact";

(b) after the entry "36/38: Irritating to eyes and skin" there shall be inserted the following entry—

"42/43: May cause sensitisation by inhalation and skin contact".

Amendments to Schedule 4

4. In Schedule 4 (which lists indications of safety precautions required and combinations of such precautions)—

(a) after the entry "23: Do not breathe gas/fumes/vapour/spray" there shall be inserted the following words—

"… [the appropriate wording to be specified by the manufacturer]… "

(b) after the entry "42: During fumigation/spraying wear suitable respiratory equipment" there shall be inserted the following words—

"… [the appropriate wording to be specified by the manufacturer]… "

(c) after the entry "7/9: Keep container tightly closed and in a well-ventilated place" there shall be inserted the following entry—

"3/7/9: Keep container tightly closed in a cool, well-ventilated place".

Amendment to Schedule 6

5. Schedule 6 (which contains special provisions relating to certain substances included in Schedule 1) shall be amended by inserting at the end of that Schedule, Schedule 3 to these Regulations.

Transitional provisions

6. Where the requirements for labelling a prescribed dangerous substance have been amended by Regulation 2(a) of the Regulations, then for 6 months immediately following the coming into operation of these Regulations as they apply to that substance, it shall be a sufficient compliance with the principal Regulations (as amended) if that substance is labelled in accordance with the principal Regulations as in force immediately before the coming into operation of these Regulations.
