BILL,
1960
TH IS Bill gives effect to many of
the
recommendations made
in Reports of the Home Secretary's Advisory Council on
the
Treatment
of Offenders,
the
Report of
the
Departmental
Committee on Children and Young Persons (the Ingleby
Committee) and
the
Report of
Mr.
Victor Durand, Q.C. on
the
Disturbances at Carlton Approved School.
Imprisonment.
The
provisions for
the
imprisonment of persons
under
21
years are further amended by providing
that
(a) Quarter Sessions or Assizes
must
not imprison
persons
under
the
age of 17, thus making this
restriction universal
(b)
the
present power to sentence children and young
persons to be detained for a specified period in a
place and on conditions specified by
the
Home
Secretary is extended to include any offence which
carries 14 or more years imprisonment
(c) persons
under
21
years shall be imprisoned only for
either less
than
6months or more
than
3 years,
subject to exceptions for persons in prison when
sentenced, those recalled or returned to prison and
those who have previously served more
than
6
months in prison or been sentenced to Borstal
training
(d)
the
power to sentence persons aged 17
but
less
than
21
to less
than
6months imprisonment may be
abolished when sufficient Detention Centres are
available.
