An Act to confirm certain Provisional Orders made by the
A.D.
1904,
Board of Trade under the General Pier and Harbour
Act 1861 relating to Hartlepool and Waterford.

HEREAS a Provisional Order made by the Board of Trade
under the General Pier and Harbour Act 1861 is not of any 24&2o Vie
validity or force whatever until the confirmation thereof by Act of
Parliament:
And whereas it is expedient that the several Provisional Orders
made by the Board of Trade under the said Act and set out in the
schedule to this Act be confirmed by Act of Parliament:
Be it therefore enacted by the King's most Excellent Majesty
by and with the advice and consent of the Lords Spiritual and
Temporal and Commons in this present Parliament assembled
and by the authority of the same as follows ;

The several Orders as amended and set out in the schedule Confirmation
to this Act shall be and the same are hereby confirmed and all the of
Orders m

provisions thereof in manner and form as they are set out in the
said schedule shall from and after the passing of this Act have full
validity and force.
2.
This Act may be cited as the Pier and Harbour Orders Short title.

SCHEDULE.
HARTLEPOOL PORT AND HARBOUR,.
Hartlepool
Provisional Order to amend the Hartlepool Port and Harbour Acts
1855 and 1869.
Short title. 1. This Order may be cited as "The Hartlepool Port and Harbour
Order 1904."
Commence- 2. This Order shall take effect from the date of the passing of the
Act confirming this Order which date is hereinafter referred to as " the-
commencement of this Order."
Interpretation. 3. In this Order the expression " the Act of 1855 " means the Hartlepool
Port and Harbour Act 1855 the expression "the Act of 1869" means the
Hartlepool Port and Harbour Act 1869 the expression " the former Acts "
means the Act of 1855 as amended by the Act of 1869 and the Act of 18G9
and words and expressions to which meanings are assigned by the former
Acts or either of them have in this Order the same respective meanings unless
there be something in the subject or context repugnant to such construction.

or presiding officer at the meeting or polling place at which he is entitled

7. Joint registered shipowners or persons being importers or exporters
o^rs'or* lp~ m partnership shall with respect to the scales of votes be deemed one person and
importers or such one 0f the joint owners or such one of the partners as shall be authorised
partnership. in writing by the majority of his joint owners or of his partners to vote at
any election of shipowners' commissioners or importers' and exporters' com-
missioners shall alone be entitled to exercise the right of voting on behalf of
the joint owners or the partnership at such election but the joint owner or
partner so authorised to vote shall not be entitled to vote at any election
unless and until he shall have delivered his authority to vote thereat to the
chairman or presiding officer at the meeting or polling place at which he is
entitled to vote.

(2) The appointment or authority of a person to vote for or on behalf of
an incorporated company or joint registered shipowners or persons bein
importers or exporters in partnership at an election of shipowners' com-
missioners or importers' and exporters' commissioners shall be in the form
set out in the First Schedule to this Order or to the like effect.
9. Each of the members of a partnership which is entered on the Persons in
register of importers and exporters shall if he possesses the qualification enaihtrfor

10.—(1) From and after the commencement of this Order all the elective Ketia-meut

shall where necessary to give effect to this provision be read and construed as
if the fourth Wednesday in January were named therein instead of the third
Wednesday in January.
(2) Elective commissioners who would but for this Order go out of office
on the third Wednesday in January next after the commencement of'this
Order shall not go out of office on that day but shall continue in office till the
fourth Wednesday in January next after the commencement of this Order in
accordance with the provisions of this Order anything in the former Acts to
the contrary notwithstanding.
(3) The sections of the Commissioners' Glauses Act 1847 with respect to
the election and rotation of the commissioners where the commissioners are to
be elected by the ratepayers or other like classes of electors shall apply to the
importers* and exporters' commissioners but so that those sections shall be
read and have effect as if the importers* and exporters' commissioners were
commissioners going out of office by rotation.

11.
From and after the first day of January one thousand nine hundred
and five section 32 of and the schedule to the Act of 1869 shall be repealed
and the following section and the Second Schedule to this Order shall be
substituted therefor respectively (that is to say) :
In addition to the duties authorised by the Act of 1855 to be taken the
commissioners may from and after the first day of January one thousand
nine hundred and five demand and receive in respect of animals goods and
minerals shipped unshipped landed or discharged at or in the harbour or at
or in any harbour dock pier quay wharf or landing place for the time being
belonging to or under the control or management of the North Eastern
Railway Company or any other person and situate within the limits of the
Port of Hartlepool or adjacent thereto the following rates or tolls namely:
(1) On animals goods and minerals respectively specified in the Second
Schedule to this Order the rates and tolls specified in the said
Second Schedule or such other rates aud tolls in respect of all or
any of the said animals goods and minerals as may from time to
time be fixed by the commissioners not exceeding those specified
in the said Second Schedule:
(2) On animals goods and minerals respectively which are not specified
in the Second Schedule to this Order rates and tolls calculated
at the rate of one penny in the pound sterling on the value of
such animals goods and minerals respectively or at such other rate
as may from time to time be fixed by the commissioners not
exceeding one penny in the pound sterling on the value of such
animals goods and minerals respectively and in case such value
shall be less than one pound sterling per animal or per ton of
goods or minerals rates and tolls may be demanded and received
as for one pound per animal or per ton of goods or minerals and
fractions of a ton shall be deemed a ton :
(3) Any animals goods or minerals which are not specified in the
Second Schedule to this Order and on which the commissioners
mny from time to time fix rates or tolls with the approval of the
Board of Trade shall from and after the date of such approval be
deemed to be included in the Second Schedule hereto :
(4) Any fraction of a penny in the total amount of rates or tolls
payable under this section at one time by any person in respect
of animals goods or minerals of each description shall be charged
as one penny.
12.
Section 33 of the Act of 1869 is hereby repealed.
13.
For the purposes of the collection and recovery of the duties rates
and tolls payable to the commissioners any harbour dock pier quay wharf
or landing place for the time being belonging to or under the control or
management of the North Eastern Railway Company or any other person
and situate within the limits of the Port of Hartlepool or adjacent thereto

shall be deemed to be within the limits of the harbour doi:k or pier within

14.
From and after the first day of January one thousand nine lumdred Commissioners
and five section 10 of tlie Act of 18fi9 aliall be repealed and the following yearly register
provision shall be substituted therefor (that is to say) : andTport'ers
(1) On or before the tenth day of January in every year the commis-
sioners shall make and print a register to be called " the Register
of Importers and Exporters" and therein shall be entered the
names in alphabetical order of all persons residing or carrying
on business within fifteen miles from the Heugh Lighthouse at
Hartlepool who respectively during the year ending on the last
preceding thirty-first day of December shall have imported or
exported into or from the Port of Hartlepool cattle goods or
minerals together with (opposite their respective names) the
amount of rates or tolls paid by such persons to the com-
missioners in respect of such animals goods and minerals or
animals goods or minerals during such year and tlie person
appearing on the bills of lading or other shipping documents in
the case of exports as consignor and in the case of imports as
consignee shall for the purposes of the register be deemed the
person paying the rates or tolls but the register shall not in any
year comprise any importer or exporter in whose case the amount
of rates or tolls aforesaid did not amount in the year ending on
the last preceding thirty-first day of December to the sum of
twenty pounds :
(2) The clerk to the commissioners shall at the foot of the register sign
a certificate of its accuracy and the persons comprised in tlie
register for the time being in- force shall for tlie- purposes of the
former Acts and this Order be the registered importers and
exporters for the time being.
15.
Nothing in this Order shall exempt the commissioners or the Port Saving for
harbour land and works under their jurisdiction or any harbour dock pier f?encr't
quay wharf or landing-place for the time being belonging to or under the
control or management of the North Eastern Railway Company from the
provisions of any general Act now in force or hereafter to be passed relating
to ports harbours or docks or to tolls rates or dues on shipping or on goods
carried therein or from any future revision and alteration under the autho-
rity of Parliament of the rates or tolls authorised by the former Acts or
this Order to be taken by the commissioners.
16. The costs charges and expenses of the commissioners of and incident Expenses of

by Parliament shall be paid by the commissioners.

WATERFOHD HARBOUR.
Provisional Order for altering for the purposes of rating the"
method of calculating the register tonnage of steam vessels?
entering or using the Port and Harbour of Waterford for
extending the limits of the said Port and Harbour and for-
altering and repealing certain existing and authorising new-
rates dues and charges and for other purposes.
1.
Subject to the provisions of this Order the Act of the ninth and tenth
years of the reign of Queen Victoria chapter two hundred and ninety-two
(local) intituled " An Act fur improving preserving maintaining and better-
'"' regulating the Port and Harbour of Waterford and for other purposes;
" relating thereto " (in this Order called " the Act of 1846 ") and the Waterford
and New Ross Harbours Act 1874 (in this Order called " the Act of 1874")
as the same are respectively amended by this Order and this Order shall be
read and construed together as one Act and this Order may be cited as tfte-
Waterford Harbour Order 1904 and the Act of

846 the Act of 1874 and this
Order may together be cited as the Waterford Harbour Acts 1846 to 1904.
2.
In this Order and the schedule hereto unless the subject or context
otherwise requires the following expressions have the meanings hereby
assigned to them (that is to say):

" The Commissioners " means the Commissioners for improving the Port
and Harbour of Waterford constituted by or for the time being-
acting under the Act of 1846 ;
" The Port " means the Port and Harbour of Waterford ;
" The rateable tonnage " means the tonnage upon which having regard
to the provisions of this Order rates dues or charges are levi ible by
the Commissioners.
Commence- 3. This Order shall come into force upon the day when the Act con-

" the commencement of this Order."
Provision as
to rateable
tonnage.
4.—(1) The tonnage of steam vessels (other than sea-going steam tugs)
upon which rates dues or charges are leviable by the Commissioners shall in
no case bo deemed for the purpose of rating to be less than forty per centunt
of the gross tannage.
(2) The tonnage of sea-going steam tugs upon which rates dues or
charges are leviable by the Commissioners shall in no case be deemed for the
purpose of rating to be less than twenty per centum of the gross tonnage.
(3) The tonnage of sea-going sailing vessels upon which rates dues or
charges ar*e leviable by the Commissioners shall for the purposes of rating
mean the register tonnage.

5.—(I)
The rates to be received by the Commissioners shall be adjusted A.JX l'H>.L
by them in such a manner that as far as possible the income of the Port shall ~
be sufficient and not more than sufficient for the purposes of the Port. Adjustment
(2) If at any time it appears to the Board of Trade from the annual rftles*
account to be sent to them under this Order that the clear annual income
derived from the Port on the average of the then three last preceding years
after payment of all expenses and outgoings exceeds the amount sufficient for
the purposes of the Port the Board may if they think fit reduce the maximum
rates leviable by the Commissioners to such sums as shall be sufficient
fx>
provide the amount aforesaid and may at any time raise those rates again-.
(3) Provided that the rates so adjusted shall at no time exceed the
maximum rates leviable by the Commissioners under the Act or Acts of
Parliament relating to the Port as amended by this Order.
6. The Schedule marked (B) to the Act of 1S4G annexed and Section 6 Repeal

Order and subject; also to the exemption from rates specified in the Schedule
to this Order the Commissioners may from and after the commencement
of this Order in lieu of and in substitution for the rates specified in the
said Schedule marked (B) to the Act of 184*6 annexed and the Waterford
additional tonnage rates in tlie Act of 1874 specified take demand collect levy
and recover rates not exceeding those specified iu the said Schedule to this
Order Provided that the rates by this section authorised to be levied by the
Commissioners shall not be levied on vessels entering the Port and plying
only to or from the Port of New Ross or to or from any place on the River
Barrow above that port.
7.—(1) So long as the Commissioners maintain and repair the existing Harbonr Jigfet
lighthouses buoys and beacons now under their control and such other dues'
lighthouses buoys and beacons as may from time to time (with the sanction
of the Commissioners of Irish Lights) be constructed erected or placed by
them within or for the purposes of the Port and light and keep lighted those
lighthouses during such hours between sunset and sunrise as may be necessary
having regard to the season of the year the Commissioners may take demand
collect levy and recover in respect of every vessel entering the Port from the
sea as and for harbour light dues any sums not exceeding the following rates
(that is to say) in respect of every vessel which having entered the Port from.
the sea and come up the same shall cross to the westward of an imaginary
straight line drawn from Cheek Point Promontory to Drumdowney Point not
exceeding one farthing per ton of the rateable tonnage of such vessel and1
in respect of every vessel which having entered the Port from the sea an<$
come up the same shall not cross to the westward of the above-mentioned'
imaginary straight line not exceeding one eighth of a penny per ton of the-
rateable tonnage of such vessel for each and every time that any such vessel
enters the Port and every such sum of money shall be paid by the owneu

agent master consignee or other person having charge of the vessel so entering
the Port to the Commissioners or the person or persons appointed, by the
Commissioners for receiving and collecting the same Provided always that
a consignee of any such vessel shall not he liable for any such sum of money
unless and until he receives notice that the same is unpaid and then he shall
be liable only to the extent of unpaid freight charges in his hands in respect
of such vessel at the time when he receives such notice.
(2) The Commissioners may (in addition to any other remedy which
they, are entitled to exercise under this Order or otherwise) recover the dues
leviable under this section in the same manner as light dues are authorised to
be recovered under Part XI. of the Merchant Shipping Act 1894.
(3) Vessels of His Majesty's Royal Navy Government Revenue vessels
vessels of war belonging to foreign Governments vessels belonging to the
•General Lighthouse Authorities or the Board of Trade and fishing vessels
employed in catching fish or in carrying to the Port fresh fish from the
fishing grounds shall be exempt from payment of the dues authorised by
this section.
(4) The expressions "lighthouse" and "buoys" and " beacons " in this
section shall have the meanings assigned to them respectively by the Mer-
chant Shipping Act 1894 and the Commissioners shall be a local lighthouse
authority within the meaning and for the purposes of that Act.
8. Fishing vessels belonging to countries with which for the time being
treaties exist exempting from duties and port charges such vessels when
forced by stress of weather to seek shelter in the ports or on the coasts of
the United Kingdom shall when forced by stress of weather to make use
of the Port and not breaking bulk while making use thereof be exempt from
the rates dues and charges authorised to be levied by this Order.
9. The rates dues and charges authorised, to be taken by this Order
may be demanded collected levied and recovered by the Commissioners or by
such person or persons as they may appoint or authorise for that purpose from
the owner agent master consignee or other person in charge of every vessel
liable to the payment of such rates dues or charges and with regard to such
rates dues and charges and the ascertainment (subject to the provisions of
this Order) levy and recovery thereof the Commissioners shall in addition to
the powers and remedies contained in this Order with respect to rates dues
and charges have all such and the like powers and remedies as are contained
in the;Act of 1846 with respect to rates dues and charges authorised to be
taken;by that Act.
10.—(1) The Commissioners shall within one month after sending to
the clerk of the peace the copy of their annual account in abstract send a
copy of jthe same to the Board of Trade and the sixteenth section of the
General Pier and Harbour Act 1861 Amendment Act shall apply to and
include any such account.
(2) The account shall be made up to the end of the tbirty-fivst day of
December in each year.

liable to a penalty not exceeding twenty pounds for every week or part of a irT~7 ^
week during which they refuse or neglect to comply with this section.
11.
The rates dues and charges authorised to be taken by this Order Application
shall he used or applied for or to all or any of the purposes for or to which of mtes &c*
the rates authorised by the Act of 1846 and the Act of 1874 are by those
Acts or either of them authorised to be used or applied or for or to any of
the purposes authorised by this Order.
12.
Section 52 of the Act of 1846 is hereby repealed and from and after Limits of port
the commencement of this Order the limits of the Port within which the
Conimksioners shall have authority and jurisdiction

and power to take
demand collect levy and recover rates dues and charges shall for the purposes
of the Act of 1846 the Act of 1874 and this Order and for all other purposes
relating to or in connexion with the Port extend to and include so much of
the River Suit- and the estuary and tributaries thereof as lies within the flux
and reflux of the tide and within the limits bounded as follows (that is
to say):
On and at the north-west by an imaginary straight line drawn from the
westernmost point of Granagh or Granny Castle in the townland of
Granny on the Kilkenny bank of the said River Suir due south to a
point in the townland of Gracedieu West on the opposite or Watcrford
bank of the said river and on and at the south or seaward side by an
imaginary straight line drawn from the Hook Lighthouse in the
county of Wexford to the southernmost point of Swiny Head in the
county of Waterfovd and at the junction of the River Barrow with
the said Paver Suir by an imaginary straight line drawn from the
southernmost point of Drumdowncy Point in the county of Kilkenny
to the southernmost point of Kilmokea Point in Great Island in the
county of Wexford.
13.
Nothing in the Waterford Harbour Acts 1846 to 1904 shall extend Exemption

14.
The officers of the coastguard and all other persons for the time Apparatus for

saving life may either permanently or temporarily and from time to time and

without payment attach or cause to be attached to any part of any jetty quay
or works spars and other apparatus for saving life and may also either in
course of using or exercising the apparatus for saving life fire rockets over
the jetty quay and works.
15.
The Commissioners shall at all times keep at convenient places on Life-buoys to
the jetties quays and works and in obedience to any requirements which may G tl'rt'
from^time to time be made by the Board of Trade life-buoys and life-lines in
good order and fit and ready for use. 43

16. In addition to the powers and remedies conferred by Section 97 of
the Act of
184>6
and Section 56 of the Harbours Docks and Piers Clauses Act
1847 or by any other Act or otherwise the owner of any vessel or of any
stone timber anchor or other obstruction at the time when such vessel becomes
a wreck or such stone timber anchor or other obstruction becomes an obstruc-
tion shall pay to the Commissioners and the Commissioners may recover from
such owner the expense if the Commissioners think fit of lighting and buoying
such wreck or obstruction and of removing dispersing or destroying such
wreck or obstruction by means of explosives or by such other means or
method an the Commissioners may consider expedient.
17.
Sections 28 and 99 of the Harbours Docks and Piers Clauses Act
1847 as incorporated with this Order shall apply to and for the benefit of
any Government Department in the same manner as they apply to and for
the benefit of the Government Departments specially named in those sections.
18.
Any vessel employe*! in the Naval or Military service of His Majesty
or in coaling His Majesty's Ships or in carrying stores of any kind for the use
of the Admiralty or the War Department and carrying or conveying at the
same time other goods or passengers for hire shall not be entitled to the
benefit of the exemption, contained in Section ISO of the Act of 1846.
Exception of 19. The following sections of the Harbours Docks and Piers Clauses Act

SO.
All costs charges and expenses of and incident to the preparation and
obtaining of this Order or otherwise incurred by the Commissioners in relation
thereto shall be paid by the Commissioners out of any of their funds.

(1) For and upon every ton of the rateable tonnage of
every vessel discharging or loading cargo or
passengers in the "Port for each and every voyage
made to or from the Port from or to any port or
place in the United Kingdom - - Threepence per ton

every vessel discharging or loading cargo or
passengers in the Port for each and every voyage
made to or from the Port from or to any port or
place not in the United Kingdom
