The Plant Varieties and Seeds (Northern Ireland) Order 1973

Present,

The Queen's Most Excellent Majesty in Council

Whereas by section 39(2) of the Plant Varieties and Seeds Act 1964(a) Her Majesty may by Order in Council made in pursuance of resolutions passed by the two Houses of the Parliament of Northern Ireland direct that such of the provisions of Part II of that Act as may be specified in the Order shall extend to Northern Ireland:

And whereas by virtue of paragraph 4(5) of the Schedule to the Northern Ireland (Temporary Provisions) Act 1972(b) so long as section 1 of that Act has effect such an Order may be made without any such resolutions:

Now, therefore, Her Majesty, in pursuance of section 39(2) and (4) of the said Act of 1964 is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:—

1. The provisions of Part II of the Plant Varieties and Seeds Act 1964, as amended by paragraph 5 of Schedule 4 to the European Communities Act 1972(c), specified in the Schedule to this Order shall extend to Northern Ireland.

2. This Order may be cited as the Plant Varieties and Seeds (Northern Ireland) Order 1973 and shall come into operation on 11th April 1973.

SCHEDULE

PROVISIONS OF PART II OF THE PLANT VARIETIES AND SEEDS ACT 1964 (AS AMENDED BY THE EUROPEAN COMMUNITIES ACT 1972) EXTENDED TO NORTHERN IRELAND

In section 16—

subsection (1) (except paragraphs (a), (b), (d) and (e));

subsection (1A);

subsection (6);

subsection (7) (except paragraph (a));

subsection (8).

In section 18, subsection (2) (except paragraph (a), in paragraph (b), the word "other" and, in paragraph (ii) the words "statutory statement or other").

In section 28, subsection (3) (except the words from "relating to a statutory" to "seeds, or" and "statement or").

In section 30, subsections (1) (except the definitions of "authorised officer", "official testing station" and "statutory statement"), (2) and (3).
