The Police Pensions (Lump Sum Payments to Widows) Regulations 1987

In exercise of the powers conferred on me by sections 1, 3 and 5 of the Police Pensions Act 19761, and after consultation with the Police Negotiating Board for the United Kingdom, I hereby, with the consent of the Treasury2, make the following Regulations, which provide for payments corresponding to payments under section 1(1) of the Pensioners' Payments and Social Security Act 19793as that Act has effect by virtue of the Pensioners' Lump Sum Payments Order 19874:
1. These Regulations may be cited as the Police Pensions (Lump Sum Payments to Widows) Regulations 1987 and shall come into force on 7th December 1987.
2. In these Regulations any reference to the old cases Regulations is a reference to the Police Pensions Regulations 19715, in so far as they continue to have effect6.
3. These Regulations shall be construed as one with the old cases Regulations which shall have effect as if regulation 4 of these Regulations were included therein.
4.—(1) This regulation shall apply to a widow who is in receipt of a pension increased under any of the following provisions of the old cases Regulations, namely under—
(a)
(a) regulation 30 (discretionary increase in widow’s ordinary pension);
(b)
(b) regulation 33 (discretionary increase in widow’s special pension); or
(c)
(c) regulation 35 (discretionary increase in widow’s award under former Acts),
where the increase is payable in respect of a period which includes a day in the week beginning with 7th December 1987.
(2) Except where a widow to whom this regulation applies is entitled to a payment by virtue of the Pensioners' Lump Sum Payments Order 1987, the police authority shall pay her a gratuity of £10.
(3) For the purposes of regulation 49 of the old cases Regulations (prevention of duplication), a gratuity under this regulation shall be ignored.
