A declaration in an action of debt for a hundred guineas, on a wager concerning the manner of playing a cast at backgammon, viz. that if a player touches a man he is obliged to move it, to be decided by the groom-porter.-Clift. The defendant makes defence and demands oyer of the writing which is read to him. The defendant then pleads in bar of the action the statute 16 Car. 2, c. 7, against excessive gaming. De murrer. If an action of debt will lie on a wager respecting the mode of playing backgammon, on a written agreement whereby the parties refer the decision to the gro&m-pwter, and one of them (the loser) binds himself in these words, " I do by these presents oblige myself, on the word and honour of a gentleman, to pay, &c."-S.
