THE POTATO MARKETING SCHEME (APPROVAL) ORDER, 1933, DATED DECEMBER 20, 1933, MADE BY THE MINISTER OF AGRICULTURE AND FISHERIES AND THE SECRETARY OF STATE FOR SCOTLAND UNDER SECTION 1 (8) OF THE AGRICULTURAL MARKETING ACT, 1931 (21 & 22 GEO. 5. C. 42).

Whereas the Minister of Agriculture and Fisheries and the Secretary of State for Scotland laid before each House of Parliament a draft of a Scheme, as set forth in the Schedule hereto, under the Agricultural Marketing Acts, 1931 and 1933 for regulating the marketing of potatoes produced in Great Britain:

And whereas the House of Commons resolved on the twentieth day of December, 1933, and the House of Lords resolved on the twelfth day of December, 1933, that the said Scheme should be approved:

Now therefore the Minister of Agriculture and Fisheries and the Secretary of State for Scotland, as required by Section 1 (8) of the Agricultural Marketing Act, 1931, hereby make the following Order:—

1. The said Scheme is approved in the terms of the said draft.

2. The said Scheme shall come into force on the twenty-first day of December, 1933.

3. This Order may be cited as "The Potato Marketing Scheme (Approval) Order, 1933."

SCHEDULE

SCHEME UNDER THE AGRICULTURAL MARKETING ACTS, 1931 AND 1933, REGULATING THE MARKETING OF POTATOES

PART I

PRELIMINARY AND DEFINITIONS

1. This Scheme may be cited as the Potato Marketing Scheme, 1933, and applies to Great Britain.

2. The regulated product to which this Scheme shall apply is potatoes produced in Great Britain and includes potatoes in course of production.

3. In this Scheme, unless the context otherwise requires, the following expressions have the meanings hereby respectively assigned to them, that is to say:—

23 & 24 Geo. 5. c. 31.

"The Act" means the Agricultural Marketing Act, 1931, as amended by the Agricultural Marketing Act, 1933;

"District" means a District constituted for the purposes of this Scheme;

"Market Supply Committee" means the Market Supply Committee appointed in accordance with the provisions of section three of the Agricultural Marketing Act, 1933;

"Minister" means the Minister of Agriculture and Fisheries and the Secretary of State for Scotland, acting in conjunction;

"Potato Acreage" means at any time, in relation to any producer—

(a) the largest number of acres of land in his occupation which that producer or a previous occupier of that land has or has had under potatoes at any one time during the calendar year then current; or

(b) if no potatoes have been planted on land in his occupation during the calendar year then current, the largest number of acres of land in his occupation which that producer or a previous occupier has had under potatoes at any one time during the preceding calendar year;

"Potatoes" means potatoes produced or in course of production in Great Britain for any purpose;

"Potatoes for human consumption" means potatoes intended to be used for human food;

"Producer" means a producer of potatoes;

"Registered" means registered under this Scheme and "registration" shall be construed accordingly;

"Retailer" means a person whose ordinary business as to potatoes is to sell them wholly or mainly to buyers who buy for domestic consumption without further re-sale.

4. The Interpretation Act, 1889, shall apply for the interpretation of this Scheme as it applies for the interpretation of an Act of Parliament.

5. In any case in which under this Scheme any right or liability depends on the number of acres of land on which any producer has potatoes, or which any producer has under cultivation for potatoes, headlands not planted shall be excluded and if the area of the land as thus computed amounts to a whole number of acres and a part of an acre, the said part shall, except for the purposes of paragraph thirty-nine of this Scheme, be deemed to be one acre.

6. Any requirement of this Scheme that a document shall be sent to, or served on a person by the Board, shall be deemed to have been complied with if, within the period (if any) limited for the sending or service of the document, the document is despatched to him by post, properly addressed and with the postage prepaid.

PART II

THE BOARD AND COMMITTEES

THE BOARD

7. The Board to administer this Scheme shall be called the Potato Marketing Board, and is hereafter in this Scheme referred to as "the Board." The Board shall be a body corporate with a common seal and power to hold land without licence in mortmain.

8. Until the thirty-first day of October, 1934, the Board shall consist of the following persons, that is to say:—
