§1. IN TRODUC T ION
Despite its rather low-key delivery by a chamber of  ve, the judgment in A v. B and
Others1 has become the focus of scholarly attention.2 An attention well deserved since
the Court addresse s two procedural issues of prime importance within their respective
elds. First, it clari es that under Regulation No 44/2001
3 acts of a court-appointed
representative cannot confer jurisdic tion on a national court for an action brought in
absentia. Second, it con r ms that the compatibility of domestic legislation w ith Charter
rights may be examined in an interlocutory procedure before a national constitutional
court as long as th is does not interfere with the requirements of Art icle267 TFEU.
