IN a recent appeal at West
Kent
Quarter Sessions it was
established
that
the
appellant, who had been convicted of
receiving aquantity of metal ingots knowing
the
same to have
been stolen, was living in the same house as another convicted
'receiver',
and
after he knew the ingots were stolen had
helped
that
other
man
to load
the
metal into amotor-car.
Though
the appellant also travelled in
the
motor-car he
did
not
alight at the other end of the journey to arrange for
the
disposal of the metal,
nor
did
the
evidence establish
that
he
handled
the
metal again.
Counsel for the appellant submitted on
the
strength of
R.
v. Brooker ((1956) Criminal Law Review 489. (1956)
Current
Law
No. 92),
that
the appellant had
not
'received'
the
metal.
The
Chairman
(Mr.
G.
A. Thesiger, Q.C.) advised
the
Court
that
afootnote to Kenny's Outlines
of
Criminal
Law
at page 290 in
the
1952 edition, which was repeated from
earlier editions, correctly represented the law, i.e.
that
taking
goods into possession for any purpose even temporary custody
or carrying was sufficient.
The
appeal was dismissed.
The
Court agreed to state a case.

An appellant at West
Kent
Quarter Sessions appealed
against asentence of three months' detention at Campsfield
House Detention Centre at Kidlington.
The
sentence had
been imposed by a Juvenile Court on a finding of Guilty on a
housebreaking charge (other offences being considered).
The
Chairman
(Mr.
G. A. Thesiger, Q.C.) said
that
the
Court
did
not
think
the
sentence was too severe, especially
as
the
appellant had previous findings of guilt recorded,
but
(despite
the
fact
that
reports from a remand home, a psy-
chiatrist
and
aprobation officer suggested detention) the
Court
was doubtful if the sentence was appropriate.
