Challenging refusal of leave to appeal

Judicial review of a refusal by the Lands Tribunal of permission to appeal to it from a Leasehold Valuation Tribunal should be granted by the High Court only in exceptional circumstances.

Mr Justice Sullivan so held in the Queen's Bench Division on September 3, 2004 when refusing the application of Sinclair Garden Investments (Kensington) Ltd for judicial review of the decision of the Lands Tribunal that it should not be granted permission to appeal against the decision of a Leasehold Valuation Tribunal disallowing certain service costs which had been charged to the interested parties, Manuela da Graca and Timothy O'Keefe.

HIS LORDSHIP said that the claimant was the landlord of a four-storey house that had been converted into flats and the interested parties had challenged the claimant's service charge expenditure.
