Ralph Bradwell Principal de Saint Mary Hall in Oxford libell in le Court del Vice-chancellour la versus un Master de Art, & commoner de mesme hall, pur ceo que il appel luy Red-Nose, Mamsey-Nose, Copper-Nose Knave, Rascal, & base Fellow, & auter words non dissonant, & ad damnura. Et Judgment fuit done pur le principal, & proeesse issue versus le delinquent de Judicio sistendo, & indicanda solvendo. Et apres le Defendant procure un prohibition directed Commissario Vicecancellar' coman-dant que il ceaser in tiel suite pur Bradwell &c. & ne procederet in Curia Christianitatis, &c. Et ore. Davenport moved pur procedendo, pur ceo que le prohibicon est ground sur Magna Charta; mes il dit que le matter fuit mistake. Car le Statute dit que touts scandalous & personal torts serront try in le common ley & neray in foro Ecclesiastico : mes nostre livers sent que si un Layman assault un Clarke, que il serra punish in le Ecclesiastical Court, dummodo non procedatur ad damna adjudicanda. Et non sumous prohibite al proceeder in Court Christian mes cest Court est Curia Cancellarii & forum temporale 9 H. 6. 44. Corpus cum causa issue al viscount de Oxford que returne breif, & &c. & causam habere non potest quia pendet in Curia Cancellarii, & la est admit bone, pur ceo que Oxford per prescription tient pleas & comit le corps al Execution. [10] Richardson. Le prohibicon est direct aolonque le libel & le substance est bone, Car les parties & le cause ont hien nosme, & donque quant est in Court Christian, ceo ne vitiate le prohibicon.
