Corporation Act, 1934.
CHAPTER xcii.
An Act to authorise the transfer of the Rams-
A.D.
1934.
gate Harbour and harbour undertaking to the
mayor aldermen and burgesses of the borough
of Ramsgate and to confer upon them all
necessary powers for carrying on the said
harbour and harbour undertaking and for other
purposes. [31st July 1934.]

HEREAS the borough of Ramsgate (hereinafter
called " the borough ") is under the local govern-
ment of the mayor aldermen and burgesses of the
borough (in this Act called " the Corporation "):
And whereas by Part VII of the Harbours and
Passing Tolls &c. Act 1861 (hereinafter referred to as
" the Act of 1861 ") the harbour of Ramsgate and
the soil thereof and all property real and personal
(including the foreshore as defined by this Act) vested
in the trustees of the said harbour or in any person in
trust for the purposes of the said harbour with their
actual and reputed appurtenances subject to all leases
contracts charges or other liabilities affecting the same
and all powers rights and privileges of imposing collect-
ing or recovering any taxes or rates of purchasing any
lands or of doing any other matter or thing relating
to the said harbour' of Ramsgate or the property
belonging thereto which might by virtue of any Act
of Parliament charter or otherwise be vested in or

1934. exerciseable by the said trustees were transferred to
and vested in the Board of Trade :
And whereas by virtue of the Ministry of Transport
Act 1919 the Ministry of Transport (Board of Trade
Exception of Powers) Order 1919 and the Ministry of
Transport (Ramsgate Harbour Transfer of Property)
Order 1920 the powers and duties of the Board of Trade
except in relation to navigation and all the property
rights and liabilities held enjoyed or incurred by the
said Board in connection with the said harbour were
transferred to and vested in the Minister of Transport
(hereinafter called " the Minister "):
And whereas by virtue of the aforesaid Acts and
Orders the Minister has the management of the harbour
of Ramsgate and in connection therewith there is now
vested in the Minister in fee simple in possession free
from incumbrances in trust for His Majesty certain
other property subject so far as the same is affected
thereby to and with the benefit of certain leases and
agreements :
And whereas it is expedient that the aforesaid
property vested in the Minister together with all plant
vessels and other property moveable and immoveable
of whatsoever kind real and personal (including any
policies of insurance against fire or otherwise) vested
in or held by the Minister for the purposes of or in
connection with the harbour of Ramsgate other than
the property described in the First Schedule to this
Act should be transferred to and vested in the Cor-
poration free of charge for all the estate and interest of
the Minister therein freed and discharged from any trust
imposed by the Act of 1861 or otherwise and that there
should also be transferred to the Corporation the right
of managing the harbour of Ramsgate and all other
rights powers privileges authorities duties liabilities
and obligations enjoyed or exerciseable by or imposed
upon or incurred by or due from the Minister in con-
nection with the harbour of Ramsgate or the harbour
property :
And whereas it is expedient that the other provisions
contained in this Act be enacted :
And whereas the purposes of this Act cannot be
effected without the authority of Parliament:

And whereas estimates have been prepared by the A.D. 1934.
Corporation for the purposes hereinafter mentioned and
such estimates are as follows : £
For and in connection with the provision
of cranes apparatus and equipment
for the harbour undertaking of the
Corporation as defined by this Act - 20,000
And whereas the works included in such estimates
are permanent works and it is expedient that the cost
thereof should be spread over a term of years:
And whereas in relation to the promotion of the
Bill for this Act the requirements of the Borough Funds
Acts 1872 and 1903 have been observed :
May it therefore please Your Majesty that it may
be enacted and be it enacted by the King's most
Excellent Majesty by and with the advice and consent
of the Lords Spiritual and Temporal and Commons in
this present Parliament assembled and by the authority
of the same as follows (that is to say):

This Act may be cited as the Ramsgate Short title.

This Act is divided into Parts as follows (that Division of

The following Acts and parts of Acts (so far Incorpora-

hereby incorporated with this Act (namely) :
(1) The Lands Clauses Acts except sections 127
to 131 of the Lands Clauses Consolidation Act
1845 (relating to the sale of superfluous lands)
