Children - resolution of contact cases

Father to blame -not system

Contact cases were best resolved outside the court system, working best where parents respected each other and were able to cooperate.

In the absence of agreement, the court's task was to treat the child's welfare as paramount, safeguarding that welfare to the best of its ability.

Mr Justice Wall so stated in the Family Division on December 12, 2003 when granting a father permission to withdraw his application for contact with his son aged 12.

HIS LORDSHIP said that the father's allegations against the mother, in particular that she had deliberately alienated the son from him, were without foundation. The principal reason for the son's hostility to contact was the father's own behaviour.
