Void vesting -Registration of personal representative as owner -Claims of next-of-kin - Real Property Limitation Act, 1874 (37 38 Vict., c. 57), s. 1 - Local Registration of Title (Ireland) Act, 1891 (54 55 Vict., c. 66).

  1. J. A. M. was in occupation and beneficially entitled to the tenant's interest in lands which became vested in the Land Purchase Commission, Northern Ireland, on the 1st February, 1932, by virtue of the provisions of Part II of the Northern Ireland Land Act, 1925. He died on 12th May, 1932, a bachelor and intestate. A vesting order was made on 18th April, 1935, purporting to vest the lands in him. This vesting order was void. From the 12th day of May, 1932, S. R. M., a brother of J. A. M., was in sole beneficial occupation of the lands until the 29th October, 1951, on which date he took out letters of administration to the estate of J. A. M., and became registered owner. With a view to selling the land, S. R. M. applied to the Registrar of Titles requesting him to investigate the title to the tenancy, to ascertain and enter on the Register the burdens (if any) appearing on such investigation to affect such lands and to cancel the note as to rights or equities appearing on the Folio.
