Backing of Warrant - Habeas corpus - Backing of Warrants (Republic of Ireland) Act, 1965 (c. 45), ss. 1 (1), 2 (2).

The appellant was charged with the murder of two persons in the Republic of Ireland and a warrant for his arrest was issued. As he was resident in Northern Ireland, an application for the endorsement of the warrant was made to a magistrate in Northern Ireland under s. 2 sub-s. 1, of the Backing of Warrants (Republic of Ireland) Act, 1965, and the magistrate endorsed the warrant for execution. The applicant sought a writ of habeas corpus on the ground that an order that he be delivered into the custody of a member of the police of the Republic should not have been made as the offences with which he was charged were of a political character within s. 2, sub-s 2, of the Act of 1965.
