Abstract
Theinternationalvalidityofconvictionscanhardlybecalledanewtopic,certainlynotwithin
aEuropeanUnioncontext.WithintheEU,mutualrecognitionofforeignconvictionshasbeen
acceptedasaleadingprinciple.Therefore,italreadygainedconsiderableattention,bothoftheEU
legislatorandoflegalscholars.However,analysisrevealsthatmutualrecognitionofforeign
convictionshasonlybeenanchoredpartiallyinthecurrentEUlegalframework.Whereasforeign
convictionsarerelevantindifferentphasesofthecriminalprocedure,mutualrecognitioninone
particularphaselacksadequateanchoring.Therecognitionofaforeignconvictionshasbeendealt
withinrelationtotheprosecutionphaseandtheexecutingphase,buthasbeenlargelyleftto
MemberStatediscretionforthesentencingphasethatcomesinbetweenthosephases.Asaresult,
someMemberStateshaveoptedforsentencinglawswhichpartiallyorevencompletelydisregard
theexistenceofrelevantforeignconvictions,whereasotherMemberStateshaveoptedfor
sentencinglawswhichinthespiritofmutualrecognitiontreatforeignconvictionsasifitwere
nationalconvictions.Thiscontributionwillarguethataninfringementoftheequalityprincipleis
possiblyatstakenotsomuchbetweenthesetwotypesofMemberStates,butwithinMember
Statesthatpartiallyorcompletelydisregardforeignconvictionsduringsentencing.Itdoessowith
specicreferencetothecaselawofboththeCourtofJusticeoftheEuropeanUnionandthe
EuropeanCourtofHumanRights.

Introduction:Thegapinthemutualrecognitionframework
Theintroductionofthefreemovementprincipleencouragedpeopletomovearoundwithinthe
EuropeanUnion.ItalsomeantthatpeoplewhohadbeenconvictedinoneMemberStatecould
travelandcouldbecaughtandprosecutedelsewhereintheEuropeanUnionforothercrimes
committed.Indoingso,questionsarosewithrespecttothepositionofforeignpriorconvictionsin
thecourseofanewcriminalproceeding.ItexposedthenecessitytoelaborateontheEUsposition
withrespecttotheinternationalvalidityofforeignconvictions.Beforetheformalintroductionof
mutualrecognitionasanoverarchingleadingprinciple,theissuewasalreadyaddressed,beit
fragmentarily.ThedevelopmentofthisEUpolicylinereallygotairbornewiththeEuropean
recognitionofthenebisinidem-principle.Art.54CISAanchoredtherulethatapersonwhosetrial
hasbeennallydisposedofinoneContractingParty,maynotbeprosecutedinanotherContracting
Partyforthesameacts.

Indoingso,theimpactofforeignpriorconvictionsfounditswayintothe
EUlegislativeframework.
Upontheintroductionofmutualrecognitionasanoverarchingleadingprincipleshaping
judicialcooperationintheEUahelicopterviewwastakenontheimpactofforeignprior
convictionsandtheeffectofthatviewcouldbefeltthroughoutthecriminalprocedure.Fromthat
pointforward,gradually,mutualrecognitionofforeignconvictionsbroadenedinscope.Instrument
uponinstrumentwasadoptedinwhichMemberStatescommittedthemselvestorecognisingforeign
convictionsduringboththeprosecutionphaseandtheexecutionphaseofacriminalprocedure.

Witheverynewinstrumentadopted,thelackofattentionforthesentencingphasebecamemore
andmoreapparent,notwithstandingitbeingclearthatpriorconvictionsmayalsohavesignicant
bearingonsentencing.
Finally,in2008,theEUadoptedtheCouncilFrameworkDecision2008/675/JHAentitled
takingaccountofconvictionsintheMemberStatesoftheEuropeanUnioninthecourseofnew
criminalproceedings

(hereafter:FDPriorConvictions).ThisFrameworkDecisionstipulatesthat
asaprinciplerequirementforeignpriorconvictionsprovidedofcoursetheyarehandeddown
inanotherEUMemberStateshouldbetakenintoaccountintheentirecourseofanewcriminal
procedure.Toclarifythemeaningthereof,theFrameworkDecisionexplainsthatthisrequiresEU
MemberStatestoattachthesameoratleastequivalentlegaleffectstoaforeignconvictionwhen
comparedtoanationalconviction.Indoingso,theFrameworkDecisioneffectivelyintroducesthe
so-calledequivalenceprinciple.WithinanEUcontext,aforeignpriorconvictionshouldhavean
effectthatisequivalenttotheeffectanationalpriorconvictionwouldhave.Differentlyput,the
originornationalityifyouwantoftheconvictionoughttobecomeobsolete.Indoingsothe
generalequalityprinciplehadbeentranslatedandhadbeenmadeapplicableinacross-border
sentencingcontext,i.e.asentencingcontextinwhichforeignpriorconvictionsareinvolved.
Ofcourse,thepoliticalcompromiseenshrinedinthetextoftheFrameworkDecisionincluded
someexceptionstothisrequirement.Apparently,notallMemberStatesfeltcomfortablewiththe
potentialimpactofimplementingthisequivalenceprinciplewithoutanyexception.Tothatend
