The Secretary of State, in exercise of the powers conferred upon him by section 1 of the Register of Sasines (Scotland) Act 1987( ( a)), and of all other powers enabling him in that behalf, and after consultation in accordance with section 2(1) of that Act with such persons or bodies as appeared to him to be appropriate, hereby makes the following Regulations:

Citation and commencement

1.-(1) These Regulations may be cited as the Register of Sasines (Microcopies) (Scotland) Regulations 1989 and shall come into force on 1st July 1989.

(2) In these Regulations, unless the context otherwise requires-

"the Keeper" means the Keeper of the Registers of Scotland;

"Register" means the Register of Sasines as construed in accordance with section 2 of the Land Registers (Scotland) Act 1868( ( b)).

Power to microcopy deeds for recording

2.-(1) The Keeper may cause any deed which has been presented for recording in the Register of Sasines to be recorded in the form of a microcopy.

(2) If by reason of the form in which any such deed has been presented it cannot conveniently be microcopied for the purpose of being recorded in accordance with paragraph (1) above, the Keeper may cause the deed to be put in a form that can conveniently be microcopied for that purpose; and paragraph (1) above shall apply to such altered deed as it applies to a deed under that paragraph.

Authentication of microfiche

3.-(1) Every microfiche containing deeds recorded in the form of a microcopy recorded in the Register under regulation 2 shall be authenticated by a microcopy certificate incorporated in the frame succeeding the image of the last page on the microfiche.

(2) The certificate incorporated in terms of paragraph (1) above shall include-

(a) the date of creation of the master microfiche;(b) the number of images contained in the microfiche; and(c) the signature of the Keeper or of an officer authorised by him.

4. Certificates of recording to be endorsed or stamped on deeds shall be in the form of Schedule 1 to these Regulations, or, in the case of deeds recorded in more than one Division of the Register, in such other form as the Keeper may determine.
