REPRESENTATION OF THE PEOPLE

The Representation of the People Act 1985 (Commencement No. 3) Order 1986

In exercise of the powers conferred upon me by section 29(2) of the Representation of the People Act 1985( a), I hereby make the following Order:--

1.--(1) This Order may be cited as the Representation of the People Act 1985 (Commencement No. 3) Order 1986.

(2) In this Order "Act of 1985" means the Representation of the People Act 1985.

2. Sections 1 to 4 (extension of franchise to British citizens overseas) and subsections (1), (2) and (4) of section 12 (offences as to declarations etc.) of the Act of 1985 shall come into force on the sixteenth day after the day on which this Order is made.

3. Subject to Article 4 below, the provisions of the Act of 1985 which are listed in the Schedule to this Order shall come into force on 16th February 1987.

4.--(1) For the purposes of an application under section 6(1) or 8(6) of the Act of 1985 which is made--

(a) by a person who, on or after the sixteenth day after the day on which this Order is made, has made a service declaration or an overseas elector's declaration in pursuance of which he is entitled to be registered, and

(b) in respect of an election or elections the poll at which is on or after 16th February 1987.

sections 6, 8, 11 and 12(3) of, and Schedule 2 to, that Act shall come into force on that sixteenth day.

(2) For the purposes of an election or elections the poll at which is on or after 16th February 1987--

(a) 1985 c. 50.

(a) sections 5 to 9, 11 and 12(3) of the Act of 1985,

(b) Schedule 2 to that Act, and

(c) in Schedule 5 (repeals) to that Act the entries relating to sections 19 to 22, 32 to 34 and 61 of, rule 27 in Schedule 1 to, and Schedule 8 to, the Representation of the People Act 1983( a),

shall come into force on 1st January 1987.

(3) Section 15 of the Act of 1985 shall not have effect for the purposes of an election in respect of which the notice of election is published before 16th February 1987.

(4) The amendments made by subsections (1), (3), (4) and (5) of section 19 of, and paragraphs 7, 9, 73, 84 and 85 of Schedule 4 to, the Act of 1985 shall not have effect for the purposes of an election in respect of which the notice of election is published before 16th February 1987.

(5) The amendments made by subsections (1), (2), (3) and (6)(b) and (c) of section 19 of the Act of 1985 shall not have effect for the purposes of any vacancy which occurred before 16th February 1987 and the amendment made by section 19(6)(b) shall not apply to any poll which has been demanded before that date.
