The Residential Care Homes (Amendment) Regulations 1992

The Secretary of State for Health, in exercise of the powers conferred by sections 5(1), 8 and 56(4) of the Registered Homes Act 19841and of all other powers enabling her in that behalf, hereby makes the following Regulations:—
Citation, commencement and interpretation
1.—(1) These Regulations may be cited as the Residential Care Homes (Amendment) Regulations 1992 and shall come into force on 1st October 1992.
(2) In these Regulations “the principal Regulations” means the Residential Care Homes Regulations 19842.
Amendment of regulation 3 of the principal Regulations
2. In regulation 3 of the principal Regulations (fees on application for registration)—
(a) in paragraph (1) the words “Subject to paragraph (2) of this regulation,” shall be omitted;
(b) in paragraph (1)(a) for “£210” there shall be substituted “£230”;
(c) in paragraph (1)(b) for “£770” there shall be substituted “£840”;
(d) paragraph (2) shall be revoked.
Amendment of regulation 5 of the principal Regulations
3. In regulation 5(1) of the principal Regulations (annual fee) for “£37” there shall be substituted “£41”.
Revocations
4. Regulations 2 and 3 of the Residential Care Homes (Amendment) Regulations 19863, regulations 2 and 3 of the Residential Care Homes (Amendment) Regulations 19884, and regulations 5 and 6 of the Residential Care Homes (Amendment) Regulations 19915are hereby revoked.

These Regulations amend the Residential Care Homes Regulations 1984.
They increase the registration fees payable on applications in respect of non-controlling managers of homes from £210 to £230 and on applications in respect of persons in control of homes from £770 to £840 and revoke regulation 3(2) of the 1984 Regulations which makes separate provision for applications on changes of ownership.
They increase the annual fee payable in respect of each person in the home, from £37 to £41.
