whereas the particulars
of
the share capital of the
Company
arc
set
forth in tlie First Schedule
to
this Act
:
And whereas the Company have
a
debenture debt
of
twelve
thousaid
five
liuiiclred pounds
:
Ancl whereas
it
is expedient that provision be made for trans-
ferring
to
the Coinmissioners the undertaking
of
the Company aiid
that the Conimisaioners should have the powers
of
the Company
except
as
herein-after provided and such other powers
as
in
this
Act mentioiied
:
And whereas there arc
on
the foreshore
of
the Ever Clmycl
adjoining the town
of
Rhyl large tracts
of
niarslilands ancl
mnd-
banks known
as
‘‘
the Foryd
Mudlaiicls
which are uncovcred
during
a
consiclcrable part of each tide and the enclosure and recla-
mation
of
those laiids
or
of
parts thereof would
be
of
public
aiitl
local tidvantage and woulcl be effected
by
tlie construction
of
tlie
embankmciit and
morks
hereinafter clcscribecl
:
And wliereas
it
is expedient that the Commissioners should be
authorised
to
appropriate all
or
some part
OF
parts
of
the said
mudlaiids
when
embanked aiid reclainied
for
the purposc
of
an
oraamental lake
and
pleasure grounds and
to
lay out plaiit oriia-
mekt
and
improve such lands

raise moneys for the
purchasc of the Company’s undertaking and
for
other purposes
of
this Act and
it
is expedient that they be suthoriscd
to
raise moneys
for
the same
in
inanner
by
this Act providcd
:

this Act contains

by
the Commissioners
for
the purchase
of
land for and the execution
of
the various works
by this Act authorised and such estimates are
as
follows
:-

the embankment and works connected therewith eight

And whereas tlic several worlts iiicludcd in such estimates
respectively are permanerit works within
the
meaning
oi
section

of
the Public Health Act

And
whereas an absolutc majority
of
the
whole
number
of
the
Commissioners at
a
nieeting held
011
thc fourth
clay
of
November
one thousaiid eight hundred
and
ninety-one after tea clays notice by
public advertiscment
of
such niceting ancl
of
the
purposes
thereof
in the
Rhyl
Journal
a
newspaper publislied aiid circulating in the
said
district
of
Rliyl such notice being in addition
to
the ordinary
notices required
for
suiiinioning such meeting resolved that the
expense
iu
relatioil
to
promoting the Bill for this Act should
be
charged
011
any
of
the rates leviable by
them
or out of moneys
to
be
borrowed
on
the security thereof
:
And whereas such resolution
was
published twice in the :Liver-
pool
Daily Mercury

newspaper cixulatiiig in the said district and
has
in
respect
of
matters within tllc jurisdiction
of
the Local
Government Board received the approval
of
such
Boarcl
:
And
whereas the propriety
of
the proi~lotioii
of
the Bill for this
Act was confirmed by an absolute
majority
of
the
whole
iiunibcr
of
the Commissioners

a
furtlier special mccting
of
the said Com-
missioners lield in pursuance
of
a
similar notice
on
the eleventh
day
of
February one thousand eight hundred and ninety-two being
not,
lcss than fourteen
days
after tlie deposit
of
the said Bill in
Parliament

by
resolution in
the
manner
provided in the Third Schedule
of
the Public Health Act
1876

to
the promotion
of
the
Bill for this Act
